...citing the likelihood that enforcement could destabilize the state's market for insurance.

I thought that was the whole point.

Well not a complete waiver, but cracks in the Dam, a camels nose under the tent.
DETAILS: Its a waiver of the requirement of spending 80 cents to 85 cents of every premium dollar on medical care and quality improvement. Maine can keep it to 65% for a few more years as the 65% has been the norm for Maine for some time.

Whatever happened to “equal protection under the law”?

There’s no way that any of these waivers are going to stand up in a court of law, if challenged.

I also saw on Drudge that Obama’s DOJ has filed their appeal per Judge Vinson’s order, in the 11th Circuit.

Put a fork in this garbage. Isn’t this a violation under equal protection?

They grant any more waivers to this disaster it will become a bill of attainder to the last man standing.

Is it just me, or does this country drift towards dictatorship when the Executive Branch can determine (via waivers in this case) which states and companies get punished by Obamacare (or any other program).

It seems that if laws are passed by Congress, they should either apply to EVERYONE, or no one.

There will be so many waivers, that it will be up to a few taxpayers, a few states (dem ones) to fund this whole mess. It’s dead, trust me!

This thing gets more and more UNCONSTITUTIONAL as it goes on. Besides the long-standing fact that the Govt can’t force you to buy something, the enforcement of Obamacare, and the waivers issued, are becoming nearly random.

The revolt this stupid piece of legislation has unleashed is truly heartening. Maybe it’s possible to undo liberal initiatives after all. Too bad Wilson, Roosevelt and LBJ weren’t as incompetent as Obama and his congressional stooges.

[. . .Maine Insurance Superintendent Mila Kofman feared that one of three major insurers offering individual plans in Maine would withdraw from the market altogether if the federal requirement remained in place.]

The 250-page Republican bill would have allowed insurers to sell in all 50 states.

Barack Obama carried Maine with 58% of the vote in the 2008 elections, and 52% of voters in the state now approve of the job he is doing... rasmussenreports.com

Three local chapters of the Service Employees International Union (SEIU)--whose political action committee spent $27 million supporting Barack Obama in the 2008 presidential election--have received temporary waivers from a provision in the Obamacare law. The three SEIU chapters include the Local 25 in Obama's hometown of Chicago. nation.foxnews.com

Health and Humand Services Grant 126 New ObamaCare Waivers…Total Waivers now at 1040 scottystarnes.wordpress.com

You don't have to be a Supreme Court Justice to see that this isn't fair. Maine should pay just like the other 57 states. So should the SEIU.

This opens up another constitutional challenge that excises have to be uniform among the states.
