Mitch McConnell has struck while the iron is hot.

One day after federal District Judge Rodger Vinson ruled that the entire Democratic health care law is unconstitutional, McConnell told his GOP colleagues that he will force a vote on repealing it, bringing it up as an amendment to the Federal Aviation Administration reauthorization bill

The Senate rules are somewhat complex and arcane. It's possible for any Senator to bring up a number of "points of order" against an amendment. Under the rules, if such a "point of order" is brought up, it can require 60 votes to clear the "point of order" and continue with the amendment. 41 votes could kill it.

The most likely rules based challenge would be on the budgetary rules, the so called "PayGo rule."

I don't know how Dingy and the Dems will handle it. If they are worried about not having 50 votes (+Biden) to defeat the amendment, they could bring a budgetary point of order and hold things up with only 41 solid votes.

I think Dingy really wants this amendment to go down to defeat on a straight vote. It's going to depend on how many votes he has. If he has 50, there will be an actual vote on the amendment. If he has less than 50, there will be a point of order, and there won't be 60 votes to clear it.

In short, it isn't how the Republicans bring it up that matters. It's how the Democrats respond.

I’m 100% behind repeal. BUT, even if it passes, Obama will veto it. I hate to give some Dem Senators some cover in ‘12.

The point is to put all the Democratic senator up for re-election in 2012 (tons of them) on the record as opposing the repeal, AND to get Obama on the record vetoing the repeal... THEN we can make the entire 2012 election about repeal.

Vote for Republicans and we can repeal this healthcare mess that Obama and the democrats are stopping us from doing, is easy for most people to understand.

Rush was saying that the Republicans shouldn’t get lazy after the Judge Vinson Ruling. He said they should go for the jugular and continue to try to repeal Obamacare. McConnell’s smart in bringing up a vote on this Unconstitutional Health Care Law. It’ll force the Dem’s to vote for retaining an Unconstitutional Law? It’s a Win Win situation for the Republicans: The Dem’s will be put on record and they will thusly incur the wrath of the voters very soon?
