Democrats say drilling firms broke U.S. law; firms say use of diesel at gas sites is legal

WASHINGTON — Drilling companies violated federal law by injecting 16 million gallons of diesel fuel underground in Texas to extract natural gas, senior House Democrats said Monday.

In a letter to the Environmental Protection Agency, the lawmakers said the companies failed to obtain necessary permits when they used diesel fuel in their hydraulic fracturing mixtures. The fracturing process, which is widely used in North Texas’ Barnett Shale, has come under scrutiny as environmental groups and some residents allege it has contaminated drinking water supplies.

The congressional inquiry, which began in early 2010 when Democrats controlled the House, did not conclude that the use of diesel polluted any drinking-water sources. The Democrats said the firms they questioned couldn’t provide data on the proximity of drilling operations to underground sources of drinking water.

Industry attorneys said the use of diesel did not violate federal law because hydraulic fracturing enjoyed a broad exemption from the Safe Drinking Water Act. Oil and gas groups have challenged a June announcement from EPA that hydraulic fracturing with diesel fuel is subject to federal regulation.

“This is a gross revision of the history of the law in this area,” said Matthew J. Armstrong, an attorney at Bracewell & Giuliani in Washington who advises oil and gas companies on regulatory enforcement.

Congress needs to mandate wind or solar powered drilling rigs and ban the use of chemicals or fuels for down-hole enhancement!!!!

Why not have welfare recipients dig the wells with shovels. Or run all day in treadmills? We could feed them Tofu. This would supply us with clean energy and give the lazy bums something to do besides watch TV and Mooch off of us.

But that agreement didn’t prohibit the use of diesel in locations where gas wells are drilled thousands of feet below the closest drinking water source, Armstrong said.

Drilling companies in North Texas say that is the case with wells drilled in the Barnett Shale, which covers 23 counties including Dallas and Tarrant.

Keep shooting from the hip instead of using reason.

BS, a friend of mine owns a few big rigs, one of his drivers run one out in the median, it cost him 13,000 to clean it up, and these a holes think they can pump it in the ground. Put the sob’s under the jail.

Huh? A truck spilling diesel? Is that what you are talking about?

What does that have to do with pumping thousands of feet below the water table into a gas well?

and these a holes think they can pump it in the ground.

Where did it come from in the first place?

Before you get too excited, you should know that the evil service company is merely injecting hydrocarbons into hydrocarbon bearing rock formations in hopes of producing more much needed hydrocarbons. In other words, they're not polluting anything that's not already polluted ... by Mother Nature.

The diesel will not leak into other formations because of the inherent nature of the rock itself ... it is a shale which lacks porosity and permeability ... or the operators wouldn't be trying to "frac" it at considerable expense. Further, most of the diesel will be produced back up the well bore and thus recovered in short order. In other words, the pollution is minimal and contained.

Right, and if you had actually read the article you would find that it is legal to use diesel below the water table.

Anyone who wants to put domestic oil and gas drillers out of business with the Middle East situation threatening energy suppllies should be forced out of their cars to ride bicycles or walk and the electricity and heat to their home should be shut off.
Live in a cave and eat worms and skunks like primitive man if that is your idea of the good life, but don’t deprive civilized people from a better life.

Probably easier to deal with recovering the diesel and re-refining it, than cleaning up polluted water. I’m pretty sure most of the diesel gets pumped back up.

You need to keep your opinion in areas that you even have a shred of a clue about!

You clearly do not know a thing about drilling or how the process is conducted. Or, the safety measure put in place in every well that is drilled.

This headline is completely ignorant, as is the claims they are making.
