Attorney General Kamala Harris enlisted California in the legal battle over health care Friday, joining eight other states in a court filing defending the new law's requirement that everyone obtain medical insurance.
The nine states, all with Democratic attorneys general, filed arguments with a federal appeals court in Cincinnati supporting the constitutionality of the law that's supposed to provide coverage for uninsured Americans. The law includes government subsidies for those who can't afford to buy health coverage and can't get it from their employer.
While the Republican-controlled House voted this week to repeal the law, a potentially more serious challenge is looming in the courts.
Four suits have been filed to overturn the law, one of them by 26 states. Last month a federal judge in Virginia ruled that a key provision, requiring all citizens to get health insurance by 2014 or pay a financial penalty, was unconstitutional because Congress has no power to force individuals to engage in economic activity.
Two other federal judges have upheld the individual insurance mandate, including a judge in Michigan whose ruling is now before the Sixth U.S. Circuit Court of Appeals in Cincinnati. That's where Harris and her colleagues weighed in Friday.
A decision to either buy or not buy insurance is "economic activity" that affects interstate commerce, which Congress has the power to regulate, the attorneys general said . . .

Isn't Iowa highly dependent on ethanol subsidies from the gubmint? Perhaps the state AG realizes what side their bread is buttered on, and doesn't want to rock the boat.

They probably think Obamacare will fix this by making people buy insurance, but it won't (in addition to being unconstitutional).
Why wouldn’t Iowa be for ObamaCare? It is a liberal state.
Iowa is one of the 5 most recent states to join with the Florida suit against Obamacare.

“Lawmakers in six other states — Maine, Montana, Oregon, Nebraska, Texas and Wyoming — are also mulling “nullification” bills, which contend states, not the U.S. Supreme Court, are the ultimate arbiter of when Congress and the president run amok.”
Even in Oregon, Sen. Wyden advised that they opt out.
BTW, I think this is they way they should go to remedy this situation. It should be left to the states, and not the courts, no matter how supreme they are.
Why doesn’t the state of kali just make it a state law for everyone to buy insurance.
No surprise that DE supports it. Koe “Stand up, Chuck” Biden’s son is the AG. This, in spite of repeated efforts by many to join the suit against DeathCare.

The Demonrat AG of Iowa supports Hussein’s unconstitutional DeathCare plan.
The Republican governor of Iowa does NOT believe Hussein’s plan is constitutional, and so the governor is weighing in for the state.
Tom Miller, the Demonrat AG is a life-long incumbent. Been there for decades.
