Victim's family sues over Schwarzenegger clemency

SACRAMENTO, Calif. (AP) -- The parents of a murdered college student say former Gov. Arnold Schwarzenegger "messed with the wrong family" in issuing an 11th-hour clemency for the son of a political ally.

Good luck to them on this lawsuit. I am for this one. This was wrong of him to do this.

I don’t know how much legal recourse these folks have, but I wish them the best of luck in their efforts. Reducing Nunez’s sentence was a despicable act and political backscratching of the worst sort, IMHO.

I’m sure Nunez the Elder(politician) earned it. It had to be a quid pro quo. But it would have been better for Arnold to welch and renege on that deal if he had any backbone. Unfortunately, I think Arnold has future business with Nunez.

A presumption that would be charitable towards Swartzenegger is that he traded something very big and very good for California in the legislature in return for this in some sort of back room deal.

Still, i wonder why he would have to honor the agreement since it is in the long run all politics and i cannot figure out any legal reason why he could not have simply reneged...

Perhaps California can issue a new type of license plate, “republicrat immunity.”

That could at least save the police and the DA a lot of pointless work chasing scum who will only get released later anyway.

I had been lamenting how Schwarzenegger turned out, especially after working on the 2003 recall. Then this. I bet the law is changed because of it.

Then there were questionable pardons by Clinton on the morning of January 20, 2001 (ten years today). Perhaps this needs to be changed on the Federal level also. Prevent pardons within 60 days of leaving office.

Fred and Kathy Santos filed a lawsuit Thursday in Sacramento County Superior Court asking the court to restore a 16-year sentence for Esteban Nunez, the son of former state Assembly speaker Fabian Nunez. Schwarzenegger lowered the sentence to seven years the night before he left office and did not contact the family or the San Diego County District Attorney's office beforehand.

Unconscionable. THEN, he wrote a letter of "apology" to the victim's family.

California is in another universe. A few years ago, a young woman was driving erratically at high speeds on the freeway down from San Francisco. She lost control of her car and collided with another car killing it's occupants. She killed the Prince of Tonga, his wife and their driver. The news stories in SoCal at the time were very sympathetic to her and her family. IIRC, she was around 18, her name was Delgado and she had taken the car without permission. I was appalled at the spin by the News media. Among the elites in California there is no sympathy for victims.
