FRESNO, California (KFSN) -- Earlier this week ABC30 showed you video of a woman who mistakenly fell into the fountain at a Pennsylvania mall, because she was distracted by text messaging. Well now that woman is suing the mall for not helping her.
The video has received more than 1.5 million views since it went viral on YouTube last week. The woman in the video, Cathy Cruz Marrero, doesn't think the video is very funny. She claims she could have gotten seriously hurt and that the security guards should have helped instead of laugh.
"I'm just like dumbfounded. And all I kept saying was, 'I fell. I fell. I fell in the fountain. I fell in the fountain.'"
Marrero has hired a lawyer to pursue legal action. The investigation is ongoing at the mall as to who leaked the video online.

And in order to defend her privacy she files a lawsuit so that all of America will know that Cathy Cruz Marrero is the pinhead who walked into the fountain while texting.
Have you seen the contract to know it was breached, or are you just assuming. Mall security footage winds up on the internet all the time, usually because it’s funny. Kid’s can drown in puddles, at least in theory, in practice fountains don’t really present any danger to kids. She wasn’t treated coldly, she fell into the fountain due to her own stupidity, and immediately got up and out of the fountain looking unharmed and then left the area quickly.
This isn’t an issue at all.
If not Bush, surely Sarah Palin. That VITROLIC TEA PARTY made her insane enough, if not to go on a shooting rampage. to try to drown herself to get away from it.
Which is not the same thing as saying this woman has any cause for a lawsuit.
She was /is just trying to finance the lawers for her old cases, have some hearth poor woman, donations can be sent care of me
As an attorney myself, I’m rather surprised she found someone to take her case. I’d laugh her out of my office. To recover anything, she has to be able to prove some damages. In the video, she fell into the fountain, stood up, and walked out. If she was not physically injured, she has no damages, and there’s no need to even get to the issue of fault.

I take it she is suing because the video was made public to her embarassment.
A mall is a public place. There is no reasonable expectation of privacy.
She could just as easily been filmed by a dozen people in the mall with cell phone cameras.

I’m sure somebody will do a great parody video to promote banning texting while walking.
Or even texting while sitting. After all, if you’re sitting on a park bench looking at your phone, then you are unaware of all the potential dangers (like bird poop, roller skaters, etc...)
The problem w/loser pays all is that sometimes a real case doesn’t get decided the way it should - I know someone who truly was wronged, yet they didn’t have a lot of money for a big-name, well-connected lawyer - while going up against a well-lawyered (team of lawyers) company - and ended up losing, though most thought it was a slam-dunk case.
Limit such “loser pays all” to “frivolous” lawsuits is a good idea... except who gets to decide/set the standard?

I remember that law suit, it was ridicules. These frivolous lawsuits should be tossed before they ever make it to court.

One thing for sure—someone this stupid & self-centered sure makes alot of the rest of us look VERY good.
