FRESNO, California (KFSN) -- Earlier this week ABC30 showed you video of a woman who mistakenly fell into the fountain at a Pennsylvania mall, because she was distracted by text messaging. Well now that woman is suing the mall for not helping her.
The video has received more than 1.5 million views since it went viral on YouTube last week. The woman in the video, Cathy Cruz Marrero, doesn't think the video is very funny. She claims she could have gotten seriously hurt and that the security guards should have helped instead of laugh.
"I'm just like dumbfounded. And all I kept saying was, 'I fell. I fell. I fell in the fountain. I fell in the fountain.'"
Marrero has hired a lawyer to pursue legal action. The investigation is ongoing at the mall as to who leaked the video online.

When frivolous lawsuits like this are brought, the loser should have to pay ALL legal fees of the defendant plus court costs.
And the plantiff’s attorney should be publicly caned.

I don't see how she could blame the mall for releasing her video, since she was unidentifiable, and I don't see how she could blame security for not helping her, since she got up and was away from there before they could have reached her.
She's fairly stupid for revealing her identity... she was on ABC's Good Morning America this morning. An ambulance chasing attorney must have gotten to her, or she sought one out.

I bet it had signs posted “Keep Out” of the fountain. She should be fined by the mall.

I take it she is suing because the video was made public to her embarassment.
I see the point but OTOH accidents can be avoided by publicizing the dangers of stationary fountains. So there is a public duty to publicize these incidents.
Young America at this time there are many stationary objects that wil not move out of your way. Some are wet, some are hard, some are at a different level than the floor.
Pay heed to your surroundings so you won’t be made fun of- or injured even.

Sounds like a great hook for a pop or rap hit.
What human being is NOT going to laugh when they see what is in that video? She immediately climbed out of the fountain under her own power and obviously wasn’t injured, so what where the guards supposed to do?
Even if they were negligent in some imaginary duty to her, what damages did she suffer from that negligence? It is not as though she was knocked unconscious and they left her there to drown like that mother who let her 13 month old drown in the tub, while she played in Facebook.

How does she prove it was HER? What if 10 more people came forward claiming it was THEM that fell into the fountain??
I don’t understand the “tort” here. To sue successfully, you have to demonstrate that harm was done to you. No adverse consequences resulted from mall security laughing at her rather than dashing out to provide assistance.
As best I can tell, she’s NOT suing for inappropriate release of the tape, since as many have pointed out, it literally is impossible to determine who she is from that tape—hence no harm etc.
If the harm is that she was made to look foolish, she ought to be suing her lawyer since now everyone knows who she is and that she had a prior record etc. It’s sort of like Gloria Allred trotting out that illegal immigrant and announcing to the world that’s what she was. Lawyers are supposed to protect their clients—not publicize their buffoonery.
