The appointed military defense counsel for Terry Lakin, the Army doctor who challenged Barack Obama's eligibility to be president by refusing to deploy again to Afghanistan, has confirmed that a request for clemency for the decorated officer will be submitted to the "convening authority," Maj. Gen. Karl Horst.
In an e-mail to WND, Maj. Matthew Kemkes said he would request clemency from Horst.
"I have already received e-mails and phone calls from many members of the public who support clemency for LTC Lakin," he confirmed.
Lakin was convicted at court martial of failing to deploy as ordered by Obama and failing to meet with his commanding officer – because he was convinced the orders from Obama may, in fact, be illegal.

I hope Lakin isn’t sitting in jail waiting for this to happen, because this has a snowball’s chance in Heck.
Suppose obama offered him a presidential pardon and full reinstatement?
If he accepted it he would be acknowledging that obama has presidential authority, wouldn’t he?

I would think that only Obama could grant clemency. Am I correct? The left would love that and it would be pretty ironic.
Don’t House committees have subpoena power to compel Hawaiian officials to produce the long-form BC? I would think that in any investigation of whether Lakin’s conviction was “just”, getting a copy of the long-form BC would be an important and useful step. If it proves beyond doubt that Obama was born in Hawaii, that will force people to confront the dual citizen issue, as that would be the only remaining avenue for claiming Obama is not NBC. Conversely, if the long-form BC demonstrates Obama was not born in Hawaii, then I think most Americans would become so outraged by Obama’s perfidy in claiming otherwise that he would be forced to resign from office.
I think for many confused citizens, Obama’s being born outside of the U.S. is a more “legitimate” reason to invalidate his claim to office than the dual citizen argument. The dual citizen issue has been out there from the get go. We are relying on Obama’s own account of who his father is in even raising that line of attack. Nevertheless, I don’t think the average American thinks Obama shouldn’t be president just because his father was a British national at the time of his birth.
So I think airing the long form BC would have a great deal of benefit, as it would force Obama to come clean about what he is hiding and why. And if it turns out there is no “there there” it allows the SC to consider only the dual citizen argument uncluttered by all the other back-up lines of attack that have been used in past lawsuits to hedge against their not buying the dual citizen argument.

Has Latkin exhausted the appeals process?

If BO isn't Constitutionally eligible for the office of POTUS, then he had no authority to send LTC Lakin into battle, put him in prison, etc., either. "You had no more authority to do this than you had to undo this." It's absurd, isn't it?
