Father of U.S. Marine on the Verge of Being Deported

In Kentucky, Juan Andres, the father of a U.S. Marine about to be deployed to Afghanistan, could soon be deported after being arrested earlier this month, but immigration officials are giving him the chance to ask for permanent residency. The 41-year-old father of five has been in this country for over 25 years. He is originally from Guatemala, and as a result of a kind gesture, he now faces deportation to his native Guatemala.

So while Andres’ son, Lance Cpl. Aspar Andres, prepares to leave for Marine boot camp then head to Afghanistan, his father begins a fight of his own.

All of Andres problems began on December 9th, when he escorted his friend to the immigration office in Louisville in order to be his translator. Upon entering, an official suspected that Andres was not in the country legally, and had him arrested.

Ron Russell, Andres’ immigration attorney, has begun collecting letters in support of Andres, including letters from his children, friends, and employers.

Though it is unusual for immigration officials to grant an arrested undocumented immigrant the chance to apply for a green card, Andres was granted time to get a case together. To gain legal status he has to prove he is of good moral character, has been in the country at least 10 years, and prove that deportation would cause great distress.

Russell believes Andres can easily prove the first two, and says Andres should be okay on the 3rd proof since his children are all citizens and he is the family’s main money-maker.

While Andres and Russell were hoping to have more time to get everything together, they only have until the end of today (Dec. 29th) to file evidence with immigration officials.

The kid swears the oath to defend the Constitution.

The Constitution guarantees every state protection against invasion.

Sounds to me like a young man with a severe dilemma.

No apparent about it, the Lance Corporal is a Marine. I know the article that is being commented on is poorly written. That is why I posted the link to the photo.

The point is simple.

When you fail to uphold the law (or standards) you get crap like this to contend with.

And as I said, we have an over-abundance of this kind of shitbird without adding any more....no matter where they come from.

I have reached my limit in tolerance for any of the above mentioned.

Wetbacks or libtards notwithstanding.

Oh contraire...a hard working person that has been here 25 years with children in the military is totally different than some gangbanger from MS here selling dope.....try to understand the difference.

So, if your kid is a Marine, you do not have to obey the law, nor are you subject to penalty if you break the law. If my kid is a Marine, can I rob a bank?

As any hardened criminal will tell you, you are only subject to the penalty if you get caught being the father of a Marine has nothing to do with it...

The young man is a Lance Corporal. I therefore believe that he is entitled to be promoted from worthless anchor baby to full-fledged citizen. Semper fidelis, and my prayers are with him and his unit as they head for Afghanistan. That place is brutal.

Yes your right, he is a Marine. It just wasn’t clear from the first article, the other articles were better written. I pray in the coming months that he will serve with honor and return safely home to a grateful nation. I certainly hope his home life will not detract him from doing his duty. It certainly would be difficult for any young man, despite the circumstances surrounding it.

The problem is we aren't weeding out anyone at this point. Perhaps we should have......criteria, other than "export them all" or the opposite "diversity is our strength"....

No it doesn’t. You don’t become a Marine until you have successfully completed training and survived the three-day final trial called “The Crucible’’. When and if you survive that, then the Globe and Anchor is put in your hand and then you are called “Marine’’.

Two promotions before he even gets to the yellow footprints? WTF? Say it ain't so.
Back in the day, we went to Parris Island as privates and considered ourselves lucky if we just got out alive, let alone PFC.

I thought we did have criteria. I thought that if you were here illegally you’d chosen to ignore that criteria.

I get your point (the guy raised a Marine) but how do you implement a scale that weighs whether a rule breaker is the right kind of a rule breaker? The guy had to break the law in order to be measured against the scale.

Juan Andres, Kentucky

Vallard Goode, has employed Andres the past 14 years at his Casey County farm, raising tobacco and beef, , says Juan was always able to provide some type of identification document.

Goode, Vallard is a private company categorized under Unclassified and located in Liberty, KY. Current estimates show this company has an annual revenue of 110,000 and employs a staff of approximately 2.

Something's goofy here...they refer to him as a Lance Corporal, E-3....I think another "journalist" is a bit confused with some details.

If he's an E-3, he's been out of Boot for a year at least.

Lance Cpl. Aspar Andres came home to Kentucky on leave from his Marine base in Hawaii, expecting a quiet visit with his parents and siblings before an expected deployment to Afghanistan in 2011.

Juan Andres already has been deported once, in 1995, after he was arrested in Georgia while driving fellow migrant farm workers who were here illegally.

Aspar Andres said he’s the second oldest of five children ranging in age from 12 to 22. He said he enrolled in the Marines shortly before his graduation from Marion County High School. He grew up mostly in Marion County, he said.

Kentucky farms such as his, she said, depend on migrant laborers.

“When they look at deporting large numbers of people like this, they don’t understand you’re going to go to Kroger and there’s not going to be food,” she said. “Because these are the people who are doing this labor.”

O’Neill (his attorney) said immigration officials need to distinguish “when is it smart to enforce the law and when is it smart to be lenient.”
