Emanuel isn't eligible to run for mayor because he doesn't meet city residency rules.
Candidates are required to live in the city for a year before the Feb. 22 election. Emanuel was working as President Barack Obama's White House chief of staff until he returned to Chicago early last month to start his campaign.
The crux of the dispute: Emanuel says he meets the standard because he owns a home here, has voted here and always intended to move back. Odelson says the fact that Emanuel rented out his home, instead of leaving it empty, means he can't claim he's a resident.

Receipts are his money. Disbursments are other people’s money. That’s what qualifies him as a modern politician.
Typical democrat strategy. Try to get your competition declared ineligible or smear them in some way. It never applied to Obama though.

A Jewish, liberal, Chicago, politician, pennypinching millionaire will often, in my experience, rent out his home to earn a few thousand dollars a year.
Doesn't matter what Chicago's city ordinances say about the matter, this was all worked out back before the adoption of the Constitution. In fact, that's one of the reasons the "common law" is referred to.
I think the ultimate standard is whether someone else wants you and I seriously doubt Rahm could run for office anywhere but Chicago and get elected.
I hope they kick this assclown all the way back to his dance studio.

Emanuel did change his legal residence. He moved his entire family when he accepted the job as Chief of Staff. His children are enrolled at school in the D.C. area.
Interestingly, neither his wife, Amy Rule, nor his family returned to Chicago, Illinois when Rahm began to organize support for his mayoral candidacy. When he made his announcement, the family flew in for the event, but that was all. It looks like they are hedging their bets.
One wonders if the only reason that Emanuel chose to rent rather than sell his Chicago property was because real estate prices have tanked. Maybe he wanted to wait for property values to increase before he sold the house. As it is now, Emanuel is living alone and renting a condo apartment from a Democratic party contributor.
Emanuel is a multimillionaire. He could easily have afforded to maintain two residences.

Rahm’s political career is now toast.
I guess he’ll have to find some mob-owned judge to give him a favorable ruling. The rules don’t really apply to him - as they don’t apply to his master, 0bama. /sarc
He still owns a house in Chicago and if he was paying Illinois income taxes the city of Chicago can stuff it. The state's laws are uniform and apply to every municipality.
