Problem is the same document created a national judiciary that is unaccountable to the people, and gets to decide what is or isn't "reasonable." Don't expect even a Scalia to save us from this crap.
The supremes also read the papers and watch TV. If there’s enough of a stink, even THEY will have to pay attention — or pay the price for their disregard of the Constitution.
Scalia wrote an opinion (Kyllo) saying that it is unconstitutional to use a thermal imaging device to view inside a home. If he wrote this, why would he not follow that argument and throw this out?
