New FDA Powers: The Wrong Remedy for a Phony Crisis (Food Bill)
heritage foundation ^ | November 17, 2010 | Diane Katz

Posted on 11/17/2010 5:49:35 PM PST by cornelis

Senate Majority Leader Harry Reid (D–NV) is reportedly pursuing a vote this week on a massive expansion of food regulation. Proponents—Democrats and Republicans alike—contend that the very security of America’s food supply is at stake. But rhetoric aside, the nation’s food supply has never been safer, thanks largely to technological advances and market forces. Consequently, granting vast new powers to the Food and Drug Administration (FDA) would raise the cost of food but would not increase consumer protection.

Thanks. Good article. The legislation is vague: "Neither specified nor even alluded to is the empowering language of what 'assist' or 'hazard analysis' or 'small entities' may mean.

And "owner, operator, or agent incharge of a facility" who will be subject to sudden regulations covers anyone growing produce.

They are in fact not vague at this point: ", each person (excluding farms and restaurants) who manufactures, processes, packs, distributes, receives, holds, or imports such article can be acted upon by the FDA." link

I think this bill includes NAIS (Nat’l Animal ID System). Every animal (chickens too) to get tagged. A year ago there were lots of articles from Mid-Western farmers about this — and the problems.

Includes all seeds (what about all the Heritage seeds people have?). Seeds from Monsanto & other giant companies only.

For some crops (flax?) farmers routinely get their own seeds but that would be disallowed by excessive rules and equipment needed to do it.

From EU/Aussies where some of the UN rules have been imposed are descriptions of all vegetation being stripped from streams near agri-industrial fields for “food safety.” Keeps wild animals and birds out. (So much for the efficacy of “bio-diversity” keeping the stream clean naturally.)

Back yard gardens are potentially subject to registration requiring the grower to record seeds, soil, fertilizer, storage and pay for inspections. Sharing of food prohibited. It is possible that organic produce would be disallowed.

Something never mentioned in this regard is how the case about the wheat grower (in the 30’s) was regulated by interstate commerce clause when he grew the wheat for his own use. (Regulation imposed because by growing his own wheat he was not buying from anyone else and therefore his actions were affecting interstate commerce.)

All I can think of when I read this bill is Russia and the Kulaks. You are not allowed to take care of yourself.

Also reminds of something read written during English Civil War that goes something like: what good is freedom if you have no land to sustain yourself.

Face it people, the problem, is all these laws. 99% of laws Congress has passed are socialism, unconstitutional AND damage freedom and the economy.

The solution is to have a Constitutional amendment that will:

1. Make ALL laws expire after 3 years. The problem is once these socialist laws are passed then they are forever, forever mandating increasing spending, increasing government growth, increasing government control etc.

This way only a few laws (programs) which are what people really want will be kept going.

And this must apply to all laws passed since the constitution was ratified. So all previous laws passed will be given 3 years to expire.

2. Documentation on each law about to be voted on must be mailed out to each American.

There is a type of law called Sunset Legislation, which subjects laws to renewal every few years.

So, thank you for this, professor.

Looking forward to Thursday evening at the Gulag, speaking with Doreen Hannes on the subject, after and along with Trevor Loudon on how George Soros fits into the bigger strategic picture.

You got the names right, but you are missing the significance... It was not a ‘committee’ vote.

The best chance to kill the horrible FOOD NAZI bill was at the full-senate cloture vote.

THAT was when it needed 60 votes to pass.

So it essentially passed TODAY, and these traitors are responsible!

Tomorrow, it only needs a simple 50-vote plus Joe Biden rubber stamp, which is almost certain to happen.
