A convicted sex offender arrested in May after DNA evidence linked him to the death of a little girl was sentenced to life without parole Tuesday after negotiating a plea deal with prosecutors. Scott Eby's plea deal, accepted by Will County Judge Richard Schoenstedt, spares him from the death penalty for the rape and murder of Riley Fox. The courtroom was packed Tuesday with relatives and supporters of the Fox family. Reporters and court personnel were in tears as both Kevin and Melissa Fox read their victim's impact statements. Kevin went first, saying he has waited six years for this day to come.
Riley Fox "While I was in jail I wondered each day what you were doing with your freedom," he said, referring to the eight months he spent incarcerated when he was considered a suspect.

And, Eby was convicted in 2005 of sexually assaulting a relative. His DNA went into the sex offender database; it was not until May of this year that he was matched as Riley's attacker.
All I can say is, a lot of people ought to be thankful that I was not that innocent man. I’d be on a real tear.

It’s heartbreaking to think of a parent to lose a child and then to go thru the horror of being accused and ground thru the system. This has to have totally devastated the family. I sometimes don’t understand what we pay the criminal justice system for.

There ought to be an automatic salary decrease for such incompetence in every case. Either do your job or get a monetary deduction.

To be fair, the father did confess, so running the DNA might not be high priority. He later said his confession was coerced. He was the most likely culprit. But I can’t believe he just volunteered a confession out of the blue - this was a man out of his mind with grief, probably not very bright, suggestible, probably hours of questioning, no lawyer - perfect solve-the-case-quickly fodder.

Didn't the Illinois governor commute all death sentences a few years back?
Because a big noisy public trial would expose an unlimited amount of official incompetence.

In Seattle they gave the Green River Killer (raped and killed dozens of women) life in exchange for his plea in two or so of the deaths. He confessed to all of the murders (dozens) to spare his life.
Prosecutors just want to clear the books, there is no justice.
“Lock up the dad, he’s the first suspect”. Same was the case in that girl who was abducted for the better part of 2 decades. The woman who matched his description as the abducter STILL matches that description and now they are questioning if she is “able” to stand trial.
“look over here, the light’s better”.
Eby was sent to prison for a 2005 charge of criminal sexual assault, according to the Illinois sex offender registry, and has an extensive criminal history, including forgery and a string of burglaries. He has been in and out of prison since 1988.
He was on parole when Riley Fox was slain and murdered, according to Will County State’s Attorney James Glasgow, who announced the charges against Eby.
