FAIRBANKS -- A judge ruled today that the Fairbanks North Star Borough must release personnel records of Senate candidate Joe Miller.
In an unusual Saturday hearing, retired Superior Court Judge Winston Burbank ruled that the public's right to know about candidates outweighed Miller's right to privacy.
Burbank ordered no release until at least Tuesday, however, to allow Miller to appeal the decision to the Alaska Supreme Court. Some of the documents will be redacted, he said.
The case was brought by a group of Alaska news media organizations, who have been trying since summer to see borough documents concerning Miller's employment as a part-time borough attorney.
Miller, the Republican nominee, fought the release, arguing that any release of personnel records violated his privacy rights
Among the documents being sought are details of his resignation from the job last year, and any disciplinary actions taken against him while employed. Separate lawsuits were brought by the Alaska Dispatch and Fairbanks Daily News-Miner. The Daily News and Associated Press joined, and the suits were combined. Among the arguments for release was that the state Supreme Court, in earlier cases, has ruled that candidates for office expose their private lives to public scrutiny.

If my memory is correct I think the Clinton’s did a good job of getting Dem judges installed all over. And, the law is what they deem it to be, not by the book.
This is sick. Typical Obamunism. Same stunts he pulled in Illinois.
Miller needs to go on the offensive. If everything is going to come out anyway, he needs to consider holding a news conference and releasing it all in and on his own terms. And he needs to use that news conference to attack the Murkoski ties to the crooked “retired” judge.
He cannot appear to either: (1) appear to be sitting around in fear waiting for the next shoe to drop, (2) fighting tooth and nail to prevent the public from hearing unsavory information.
He has to go on the offensive.

The Associated Press reports that an Alaskan judge has ruled that the personnel records of Republican candidate Joe Miller must be released, because apparently the interest of public knowledge outweighs the interest of individual privacy.
Several news organizations sued for the information. The Daily News-Miner reported Saturday that retired Superior Court Judge Winston Burbank says the publics right to know outweighs Millers right to privacy.
Miller recently acknowledged he was disciplined for violating the ethics policy while working for the Fairbanks North Star Borough, but said it was unrelated to his departure from the borough.
Burbank ordered that the documents be released by 4 p.m. on Tuesday, which allows time for an appeal. Media attorney Chris Zimmerman says he expects Millers attorneys to appeal the decision to the Alaska Supreme Court.
Judge Winston Burbank has a serious conflict of interest in this case. Namely, he was appointed by Governor Frank Murkowksi. As in the father of Lisa Murkowski, Millers chief opponent. From the Associated Press in 2003:

Winston Burbank, 54, was picked for a District Court judgeship.
Burbank has been semiretired for the past five years. Before that, he was a partner in the Fairbanks law firm of Call, Barrett and Burbank, where the bulk of his practice was personal injury law for both plaintiffs and defendants.
Burbank also served as a temporary District Court judge while Judge Jane Kauvar was on sabbatical leave.
So we have a judge appointed by Lisa Murkowksis father ruling that Lisa Murkowskis main opponent has to release potentially damaging information. Theres something seriously wrong there.

Exactly. Obama won his senate seat by getting a judge to release the divorce records of his opponent but we can’t even see his birth certificate. That’s fair.
Looks like the Alaska cabal is doing to Miller what they did to Palin in 2008. I would not be surprised if Murkowski uses this horribly-timed issue to skate to victory.
