“Insurgents” kidnap her and threaten her life. A SEAL accidentally hits her with a frag grenade during the rescue mission ... and the SEAL is charged. How retarded.
Felony murder. Any death, accidental or otherwise, resulting from a criminal act is the fault of the criminal ... including those accidentally killed by the good guys during rescue operations, gunfights, etc.

This was an unfortunate outcome of a decent operation - it happens in warfare. To punish this individual is simply wrong. Yes, he made a wrong decision under duress and those that sit back comfortably behind their desks want to punish him...just wrong. I also wish it had turned out differently, but don’t punish those for wrong spur of the moment decisions during wartime... That is just wrong and unfortunately politics at its worst!
The military takes after action reviews--"hot washes"--very seriously. From what I have read, this is especially true in special operations forces. Failing to acknowledge a mistake like this would absolutely be a problem.
This SEAL will beat himself up far more than anyone else can.
Why didn't the British deal with this...
Seems that the main problem was the apparent cover up. Probably would have been best to say “I didn’t see her, I threw a grenade.”
Of course, with such a political Pentagon, I can see why our bravest immediately go into CYA mode.
