This case illustrates one of the fatal flaws in any "legal" process that involves foreign nationals captured on foreign soil by U.S. military personnel and/or intelligence agents. The U.S. legal system simply isn't equipped -- from a jurisdictional standpoint, a legal standpoint, etc. -- to deal with this kind of prosecution.
And I hate to come to the defense of the Obama administration on this, but this bullsh!t all started under the previous administration.

To be fair, it was the courts who intruded on the Bush Administration’s dealing with many cases. The USS Cole case may be different though, if it was begun before 9/11, when Bush realized everything had changed.

I think that’s why Bush wanted them tried in a military tribunal and why the obama admin is now figuring out it has no choice but to try them in a military tribunal. Is it not?
