A campaign to create a new category of driving while intoxicated is being promoted at the Capitol as one way to curb growing problems in Texas' system of punishing drunken drivers.
Austin Police Chief Art Acevedo, among the supporters of the change, said the idea behind a new offense of "driving while ability impaired" DWAI would cover drivers whose blood-alcohol content is between 0.05 and 0.07

Are the breathalyzers(sp?)tested for accuracy? I checked into this once (for a, are you ready? .005, yes that is correct-under-age)and they need to be calibrated regularly and the margin for error needs to be shown. oh, and for this model,005 was the margin. lol And, it is true that mouthwash can trigger a reading, along with many other innocent items.

This law basically says that if you have a beer at the local fish fry or BBQ and you have an accident, You are screwed.
It would have to be Texas.
This is the state in which, a few years ago, Texas Alcoholic Beverage Commission police went around arresting people for drinking in bars.
They tried to claim that it was to prevent drunk driving, but then it came out that they were arresting people in hotel bars who were staying in the hotels. Oops. Driving an elevator while drunk isn’t illegal yet, even in Texas.
They stopped after news of it spread internationally and the state became a laughingstock around the world.
Rules are written in blood. That is why we have them. If stupid people would conduct themselves, we probably would not need any laws. The problem is that there was some people who got in their car with a .05 to .07 and killed someone and a law is needed. Why not just have a designated driver if you are going to have a drink with dinner? It really is very easy to do or a cab to take you home and then you can drink as much as you want.
Good Lord! If you get caught texting or doing a voice call and driving in a school zone they will string you up!
And EVERYONE does that. Except me.
I rarely even answer the phone when I am driving.
I swear folks. the Cell phone will be considered the same as driving while intoxicated.
Just keep passing laws.

Id like to know what the normal blood alcohol level is. I doubt that it gets to absolute zero. It is possible that we are getting into a range that will be triggered by a number of other chemicals, already in the blood stream.

Diabetics will almost always register some alcohol on a breathalyzer test even if they never drink..
Did any of you read the stat on the second page? 12% of accidents were caused by drunk drivers!!

So question is,can they make you submit to a blood test?
Can they stop you without a reason?
Can they due any of this without cause to protect us from ourselves?
Are we 2 year olds that have to be protected from ourselves and everything else?
Seems the answer is yes,and we have just rolled over as they passed more and more draconian laws,till now I barely leave home because I know I am breaking a law somehow ,someway.
I thought Texas was crazy while I lived there. You could drive thought a dry county with an open container. They had beer commercials about getting a beer for the drive home. Something about .. Grab a little hinny on the way home. I don’t think this is still true.
Alcohol was a contributing factor in 33 percent of all fatal crashes in the past three years, the statistics show. Acevedo said that is holding true for 2010, as well.
You fell for what I refer to as the "Weasel Phrase"! "Alcohol-involved" or "contributing factor" merely means that there *MIGHT* have been some booze in the driver's system, or in the car, or even in the hand of some pedestrian walking down the street that the driver noticed.
Here in BC, even if there is no reason to suspect you are impaired, there is a new law on the books that compels you to blow, and if you blow 0.05 or better, even though you are NOT impaired, your licence is suspended for 4 to 10 days, and your car towed at your expense to a lockup where you are forced to pay storage fees until your licence is reinstated.
This is even though you have committed NO LEGAL or even regulatory OFFENSE, since the legal DUI/DWI limit remains at 0.08!
