23 Million Americans Hit by a Tax Hike, But They May Not Know It Yet

(CNSNews.com) - Almost 23 million American households are about to have their federal taxes raised by an average of $3,900 this year, but they may not know it yet.

They could get a big surprise when they prepare their tax returns next year.

Among those subject to this already-in-place tax increase are some families making less than $50,000 per year, and virtually all married couples earning between $100,000 and $500,000 a year, according to data published by the Congressional Budget Office.

The looming tax hike is contrary to President Barack Obama's repeated promise not to increase taxes on any individual earning less than $200,000 a year or on any household earning less than $250,000.

"As the law now stands, virtually all married couples in America earning between $100,000 and $500,000 will be hit with the AMT this year--on income they started earning ten months ago. "If nothing is changed this year, one in six taxpayers will be affected by the AMT, paying on average an additional $3,900 in tax, and nearly every married taxpayer with income between $100,000 and $500,000 will owe some alternative tax."

June 22, 2010 Majority Leader Steny Hoyer (D-Md.) confirmed in a speech that the House Democrats will not pass a budget in 2010.

July 1, 2010 the House of The House of Representatives passed a budget enforcement resolution. “This budget enforcement resolution will enforce fiscal discipline in the near term while the fiscal commission works on a long-term plan to get our country back to fiscal health,” Hoyer’s stated.

According to Steve Keen of blog.heritage.org:

“This is not a true budget. All future federal spending and revenue projections, which would normally be included in an actual budget resolution, are conspicuously absent in what was passed last night."

"This has never happened. The House of Representatives has passed a budget resolution in every single year since the modern budget process was established in 1974—until now."

"The budget resolution functions as the budget of the Congress, setting both federal spending and revenue levels for the next five fiscal years. The “budget enforcement resolution” differs greatly in that it covers only a single year and completely ignores both mandatory spending and revenue.”

Article I, Section 9 of the Constitution reads in part, “No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time”.

Certainly a “budget enforcement resolution” fails to meet the definition of “Appropriations made by Law.” The House’s “enforcement” — or deeming — resolution will endorse the goals of the president’s fiscal commission and reiterate the commitment to vote on its recommendations after midterm elections”, further remarks Hoyer.

So it appears that Congress is subjugating its appropriations responsibility entirely to the office of the President. Indeed, many laws of the land now are made through the stroke of the President’s pen through “executive order” much like “Kings Decree” of times past.

Additionally, this president has surrounded himself with others who appear to be helping to move America toward a Socialist, anti-constitutional form of government in rebellion to the Republic form of government guaranteed by our Constitution.

Usurpers and tyrants carry out objectives by first acquiring the power to do so. One of the tools in this case is unlimited funds from taxes and uncontrolled obligation of America to a debt only our great, great grandchildren could hope to pay.

Our founding fathers wisely put safe guards in the Constitution one of which is Section 4 of the Fourteenth Amendment:

“The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.” Unfortunately, on July 12, 1909, the resolution proposing the Sixteenth Amendment was passed by the Sixty-first Congress and submitted to the state legislatures.

On February 25, 1913, Secretary of State Philander Knox proclaimed that the amendment had been ratified by the necessary three-fourths of the states, and thus had become part of the Constitution. Shortly thereafter, the Revenue Act of 1913 was enacted.

This act made the States powerless and put the vast burden of tax not on the states but on the backs of everyday Americans working day to day, too exhausted trying to make a living to guard against the fruits of their labor being used against them to grow a government leviathan.

Now the full weight and authority of the Federal government is used to shake down individual Americans, taking large portions of their income, growing government and rewarding or bribing those who would support it by providing for their very existence.

Upon passage of the sixteenth amendment, whereby Congress shall have power to lay and collect taxes on incomes, from whatever source derived, I contend also granted authority to whoever pays any debt or obligation (the taxpayer in this instance) the responsibility under the fourteenth amendment to not to do so if funds would aid in insurrection or rebellion against the United States as may be the case.

I therefore believe that organizations and individuals in the public and private arena representing the individual taxpayers of these United States should redress the courts and seek an injunction that will halt the collection of taxes for the 2010 tax year until lawful appropriation bills are presented on the house floor and affirmed by a majority of our congressional representatives and investigations of "possible" misappropriations and obligations conducted.

AMT triggers include mortgage interest. I'll be doing my taxes with and without the mortgage interest on my 2nd house. It may be cheaper to ditch the deduction than to trigger the AMT.
