Kagan will hear the first case argued before the court, then slip quietly through the burgundy velvet curtains behind the bench. She'll be out of the action in all three cases : Tuesday. Her chair will be empty when the court returns next Tuesday and she'll put in a half-day the next day.
Kagan's old job as solicitor general - the "10th justice" - is initially making it hard to do her new job as the ninth justice.

Recusing herself from anything to do with a legal analysis is the thing to do.

Considering she has forty years on the court, one year really won’t matter in the big scheme of things...../sarc.
When judges move from the Department of Justice to a court, the rules of judicial ethics require them to recuse (disqualify) themself in any case they worked on as a government lawyer. Rehnquist was recused from many cases during his first term on the Court, for the same reason. By next term, this won't be an issue.
There are many things to criticize Kagan for, but this isn't one of them; she is following the law.

We should be happy that she is forced to recuse herself from many cases this term. We knew we were going to get a leftist, but at least she can’t do as much harm as someone who wouldn’t have to recuse themselves. In a close case, it could be the difference between winning it and losing it even if Kennedy votes with the socialists.
Can anyone possibly believe that George Bush would have been able to get a nominee to the bench who would have to recuse themselves repeatedly because of “bias” for arguing for Bush’s viewpoint on numerous cases?

Lefty Senator Patrick Leahy is trying to “remedy” this “problem”, according to an editorial in the WSJ today.
Leahy is apparently going to propose legislation - as if Congress can “legislate” SCOTUS appointments - that would place a retired SCOTUS justice temporarily back on the bench to participate in a case where a sitting justice recused themselves.
Of course the conniving Leahy is explaining his proposal as the "benevolent" motive of seeking to avoid 4-4 tie votes.
