Criminal proceedings against kidnapper of schoolgirl Jaycee Lee Dugard halted

Criminal proceedings against the man accused of kidnapping Jaycee Lee Dugard have been sensationally halted because of concerns about his mental state.

Superior Court Judge Douglas Phimister made the decision yesterday after a short pre-trial hearing for Phillip Garrido.

Phimister said he had concerns about Garrido's mental competency to participate in his defence.

He is facing 29 counts of kidnapping, rape and false imprisonment in the 1991 disappearance of Dugard

More correctly, they twice saw and spoke to Jaycee, observed the not-to-code living quarters in the back yard, and didn't bother to ask why a convicted, paroled sex offender had an unknown young woman in his backyard, or why he would build living quarters there.

The criminal justice system has it backwards. They exist to protect the innocent population from being preyed upon by a proven preditor. It’s not their job to protect the preditor from “unfair” treatment. It’s their job to establish the fact that this person committed the crime regardless of his state of mind and do away with him in order to protect the rest of society. That’s it.
