Officer in Costco shooting says man raised gun, didn’t know it was in holster

This comes from a Vegas paper, so I'll summarize:

Day 1 of the inquest into the police shooting of Eric Scott at a Las Vegas Costco emphasized the large amount of prescription painkillers found in his body. The assistant DA suggested Scott was suicidal.

Day 2 apparently spent a bunch of time explaining why there will be no video...basically, the machines weren't working, sorry.

Then the cop who was closest to Scott testified. In his testimony, he says the gun found by investigators was in its holster, and that he didn't realize the gun was in its holster when he shot Scott. That info comes about 2/3 of the way into the article:

“Misgivings”? Sure. Maybe he shouldn’t have died.

But ... I’m not sure he shouldn’t have died. I’m certainly not sure enough to ring-up a cop for shooting him.

This isn’t a cop out on a power-trip or someone that was just looking to shoot a guy. He went to a call because of an erratic individual, stopped him, saw him go for a gun, and shot him. His action, even if wrong, was reasonable under the circumstances. I’m not sure I’d have done anything differently in his shoes.

Actually, the cop specifically testified that at the time he fired, he didn’t know Scott’s gun was in a holster. It was only later, when he saw the gun in its holster on the ground, that he realized the gun was still hostered.

So far two employees have also testified that the gun was pointed at the officer, and made no mention of the holster. It must be a fairly insignificant holster.

The Costco employee testified Scott wasn’t acting like a threat. However, the call to 911 made it sound like a nutcase was in the store.

The Costco security person testified that Scott separated from his girlfriend, stumbled while he walked, and touched his gun several times. He also reported that he reached for his gun when the first officer approached him, but hadn't pulled it out yet.

And Rush Limbaugh is proof that you can have high levels of prescription drugs in you and still act normal.

Was Rush on potentially lethal levels of Xanax as well as pain killers? Was Rush also being a hypocrite and liar at the time?

What does that have to do with Costco having an open service call on their video security system days before the incident?

The extra time needed for the kangaroo inquest would be a nice amount of time for the perps to get their ducks in a row with the "repair" company. Having been in tech service, I can imagine those phone calls...

COSTCO's lawyers - and I'm sure they have a bevy of 'em - aren't advising their clients to tell the truth, they're parsing, finessing, trying to plant that little seed of doubt that'll reduce their clients liability. Accept their word? Not I.

Same with the city, and they have physical access to all of the "facts", with the exception of the witness testimony. Neither will I take their word for it.

So, all I'm left with is my common sense, and I would advise you not suspend your's so willingly.

Especially where lethal use of police power is concerned. We simply cannot afford to.

The officer testified that he has a holster just like it, and that he knows the gun can be fired while it's in the holster.

Sounds like Porkie the Executioner had plenty of time to think that load of manure up...

The witnesses don't back up that claim. Try reading some early articles for witness statements. They don't match the cops story.

That would also mean that the Secret Service and Seagate are in on your conspiracy. If you read the articles at the Las Vegas Sun about the inquest you would know that.

The 911 tape has the cop telling him to “drop it”. In the cops testimony, he doesn’t mention that he told Scott to “drop it”. The cop is conflicting his testimony with what is on the recording.

IMO, the cop, caught up in the heat of whatever preconceived notions he had at the time prior to arrival at Costco, FORGOT that he gave the victim an order to “DROP IT” and shot victim when the victim began to comply with that order.

I note also, that in the tape, the cop gave what could be construed as very conflicting orders, “Show your hands, drop it, get on the ground”

I don’t believe it was “reasonable” at all when you take into account the orders the cop gave (recorded on tape) and the conflicting testimony he gave in court.

Something stinks.

ROTFLMAO! What do you think two Costco employees are going to say, after getting coached by Corporate Legal? That is, if they want their jobs and no trouble in their lives?

It may be the drugs Scott was using clouded his judgment in how to respond, but ...

It may be the drugs the police officers were using clouded their judgment in how to respond, but ... they murdered him anyway, according to several of eye witnesses.

Oh yeah, I read it. It was almost laughable. We’re supposed to believe that the cop who fired the fatal shot was close enough to see the victim had bloodshot eyes but not close enough to see that his gun was in a holster? I remember reading the transcript the dispatcher shortly after it happened but I don’t remember any caution about the victim being a Green Beret - that was a convenient addition to the story, wasn’t it? There are so many holes in the testimony that you could sell it for swiss cheese.

No, I haven't read the article, but I'll point out that the mad scramble began BEFORE the Secret Service would have gotten involved.

Seagate? Costco is a huge corporate account, no doubt.

The story goes that if a cop determines someone is dangerous to them they can harm them up to and including murdering them on the stop.

Given this man’s poor physical fitness, he would be feeling more vulnerable than most people and that might explain why he did what he did.
