'Open carry' group pledges to sue police for issuing citations

A Wisconsin group that promotes "open carry" of firearms says it will take action against Madison police after two of its members were issued citations for obstruction Saturday night when they refused to identify themselves at a restaurant.

The incident occurred while five members of Wisconsin Carry met and ate at a Culver's restaurant near East Towne Mall, said Auric Gold, the group's secretary.

Gold said each of the five men was "wearing a holstered firearm, a legal and constitutionally protected activity in Wisconsin."

42USC1983: Every person who, under color of any statute, ordinance, regulation, custom or usage, of any state or territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction of the United States to the deprivation of any rights, privileges or immunities secured by the Federal Constitution and its laws, is liable to the party injured in an action at law, suit in equity or other proper proceeding for redress.

Sue their asses off.

Related, but tangentially -

legislation should be passed in each state requiring agents of the government (including/especially LEOs) who are representing themselves as such,

to be individually identifiable,
and citizens’ rights to record the activities of such agents be affirmed.

And any officer/agent that obstructs these requirements is to be individually responsible, both civilly and criminally.

The comments are a useful and instructive read. Most of the ‘objectors’ “feel” that carrying openly is a deliberate provocation and the police are justified in their actions.

Hmmm. So if you are doing ANYTHING a Leftie doesn’t like, they feel you can be in violation of ‘something.’

I bet they feel the same about non-Leftist FREE speech as they do about open carry.

The police have to do what the administration tells them to. The administration is corrupt and interfering with the rights of innocent citizens. They should sue the administration that told the police what to do.

I believe "I was just following orders" was shown to be an inadequate defense when the consequences of not following orders could be death (nuremburg trials) When at the most the consequences of not following orders could result in being fired, then this is an even weaker defense. The police were acting as all too many do as government jackbooted thugs and stepping all over citizens' rights.

It has been my personal observation that thugs don't wear jackboots any more. They do wear jump boots these days so the JBT is still operational.

The comments section (or parts of it) could have been lifted from an FR thread.

BTW, my dad gave me some advice when I joined the Service.

"Never argue with a man carrying a loaded machine gun"

IF the police officer (pig, bull, etc, etc) wants your ID, give it to him/her. The place to argue is in court - you are a lot less likely to get shot, if for no other reason.

Cops do not like being told NO. It pi$$es them off and most carry loaded weapons. Be smart - follow Chris Rocks advice....
