A New Jersey man who burned pages from the Koran outside a planned mosque near Ground Zero was fired from his job at NJ Transit, sources and authorities confirmed.
Derek Fenton, an 11-year employee at NJ Transit, was fired Monday, the agency said in a statement, two days after he was photographed burning the Koran.
"Mr. Fenton's public actions violated New Jersey Transit's code of ethics," NJ Transit said.

Interesting. I know there are cases where city/state/federal employees have been terminated for saying
racist things even outside the workplace. And, those terminations have been upheld in court, BUT, Islam is not a race. It's a religion. If you enjoy freedom of religion, then you also enjoy freedom to openly criticize, mock and ridicule religion - Islam, or any religion.
I don't see how the state of NJ could infringe on this man's 1A protections, but I'm not a 1A or employment law authority. It's an interesting question.

He has been reported as an “at will" employee which would mean that the employer doesn't need a reason to terminate him. We need someone who has legal knowledge of NJ employment law and NJ transit employment provisions to look at this situation.
