School Suspends Boy for Bloodshot Eyes

TROPHY CLUB, Texas - Administrators at Byron Nelson High School in Trophy Club suspended a 16-year-old boy on Tuesday because his eyes were bloodshot and they thought he might have been smoking marijuana.

The teen said he was not high. Instead his eyes were red because he had been grieving the loss of his murdered father.

Kyler Robertson’s father was stabbed to death on Sunday. His mother honored his wishes and let him go to school on Tuesday to be with his friends.

“I am sure he had a lot on his mind going to school. I had asked him not to go to school,” said Cristy Fritz.

Before returning to class Kyler had to go to the office to get a tardy slip. That’s when school employees accused him of being high because he had red and watery eyes.

Fritz said she got a call from administrators who told her Kyler would be suspended for three days.

“I was pleading with her to understand the severity of the situation, his emotional well being. How could they do this to him at this time? What are the alternatives?” she said.

District spokeswoman Lesley Weaver would not discuss the case with FOX 4, but said when administrators suspect a student is under the influence, a school nurse will observe symptoms like their behavior, odor and their eyes.

The district does not actually test students, though. That’s left to the parents.

Fritz said she was told by the assistant principal that she could have Kyler tested for drugs within two hours and if it was negative he could return to school. She did just that.

Kyler was allowed to return to class after he showed school administrators a copy of his negative test results.

The teen’s mom still wants an apology from administrators and she wants the district to remove the suspension from his permanent record. She is in the process of appealing it.

“We had other things to do this week than worry about a three day window for an appeal, a two hour window for a drug test and my son’s reputation and high school career,” she said.

This is the first high school named in honor of Byron Nelson, and opened in the fall of 2009. The school is located in Trophy Club, Texas, near Nelson’s hometown of Roanoke.[

If he was tested by an independent lab then I would agree that he did not smoke pot.

The surviving parent was required to have him tested within two hours.

It's in the article.

I'm sure she did it at lab she owns and controls, aren't you?

The state is a machine with no heart and no brain. They do not care about anything and they abuse with the extraordinary power we have given them. The state is always wanting to grow into a nuke power plant; the people are supposed to put the hammer on it, keeping it within the boundries of a primative camp fire.

We have to cut the governments like bats out of hell. We can do it in the name of and power of the constitution. Every community has to organize to do this to every government machine in existence.

Yeah, in addition to having bloodshot eyes, they said he "smelled of marijuana". Since the urine test came back negative, I'm thinking they were trying screw this kid as hard as they could.

I don't think a simple apology is sufficient. They tried to ruin this kids future. It's inexcusable.

It makes perfect sense for him to want to keep to his regular schedule. Staying busy is a time-honored way of dealing with grief. He was also avoiding all the funeral stuff at home.

Yep, I did the same myself when my father passed on. Kept on working for the first week, and then resigned after the funeral.

You forgot the transfer from Engineering to Business. Lots of my classmates did that at Purdue. Most are probably making more money than I am now.

Also I would put PreMed first and PreLaw after Engineering. Depending on the Science it could be put ahead of PreMed (especially Physics).

I'll second that - I went to a private school thru ‘most’ of 7th grade - then off to public.

I believe I had a better education by 7th grade than most of the public HS ‘graduates. And this from back in the day before the FedGov became the 800 lb gorilla..

If the school thinks he did drugs, then it is their responsibility to prove it. I suppose they could have asked the parent for permission to take a test under their controlled environment, but chose not to and left it up to the parent instead. I guess administering drug tests isn't in their union contract.

The inability or unwillingness of the school to prove it's thesis should not reflect poorly on the kid.
