Righthaven wins key ruling as new criticism leveled over suits

The Las Vegas Review-Journal's online copyright enforcement partner won an important legal ruling in federal court Thursday -- just as a new round of criticism erupted over the no-warning lawsuit campaign over Review-Journal stories.
In a case pitting the Review-Journal's partner, Righthaven LLC, against a Texas law firm, Chief U.S. District Judge for Nevada Roger Hunt denied the law firm's motion to dismiss the lawsuit.

Righthaven "trolls" the Internet to find online infringements of Review-Journal stories, then obtains copyrights to those stories from Stephens Media LLC and finally files no-warning copyright infringement lawsuits based on the retroactive infringements. And this sleezy practice is ok with the courts, good grief.

The court has made no ruling on the substance of the case, just that it is theoretically possible that there might be a case.

Please see Federals Rules of Civil Procedure 12(b)(6):
http://www.law.cornell.edu/rules/frcp/Rule12.
Basically, if you are a lawyer and you do not file a motion to dismiss, you are not effectively representing your client. If the court chooses not to dismiss as it does (probably) most of the time, it is not a "win" on a "key" ruling, as the headline suggests.

Courts do not like being used as instruments of no-notice extortion.
I would expect some defendant will become a counter-plaintif and successfully move to change venue from Southern Nevada District to some District where the defendant/counter-plaintiff resides, and make the extortionists defend there.
