Was Blagojevich a federal official? What they finally got him on was exactly this federal statute, but he was acting in the capacity of an ILLINOIS official, trying to sell a Senate seat.

The role a person is playing doesn’t matter; all that matters to the law is whether a federal issue is impacted and whether the person had a legal duty to not conceal. And Hawaii law is clear that it is required that Administrative Rules be posted on the websites of the HI agencies.

OK, now I see the connection. Per se, lying about HI’s administrative rules is against Hawaiian statutes, which isn’t under federal jurisdiction. But you’re saying it’s in the service of perpetuating a fraud whereby Obama illegally draws a federal salary and has control over the spending of a vast amount of federal funds. In terms of prosecution, it’s far easier to build a case on raw facts—i.e., Fukino did or did not lie/misrepresent what Hawaiian required—than a case built around proving the motivation behind the lying. Unless there’s a smoking gun memo that nails down her frame of mind, I would guess that proving motivation would be pretty difficult. So you may be correct in a technical sense, but I’m guessing that even with an Attorney General with integrity in place, a federal prosecution against Fukino would be unlikely. JMO.
