A Waite Park man won't have to pay fines for hanging anti-Islamic posters on utility poles in St. Clou
An administrative hearing officer on Friday dismissed two $100 citations against Sidney Elyea. He ruled that St. Cloud selectively prosecuted him for violating an ordinance against posting materials on utility poles.
The ruling by Russell Cherne said the city has never issued a citation in hundreds of previous violations of the ordinance, typically for lost pet or garage sale signs. The city has usually issued cease-and-desist orders instead, and Elyea will get one.

'Bout damn time.
WaitePark/St. Cloud is Michele Bachmann territory.
YEAH BABY!!!!!
Posting fliers = hate crime.
Building a mosque at Ground Zero = bridging the divide.
When will you people in flyover country learn “tolerance”?
Good ruling.
Okay, I want to know who this mans uncle is and why he totes so much political power to allow such an anti-liberal injustice in St. Cloud! ; )
Right on...I hates everyone...
Take note of the phrase "administrative hearing officer." Such individuals virtually always insist on being called "judges" and wearing black robes, both for the aura of authority and to hide their actual status and its extremely limited jurisdiction. These days, they are the only "judges" anyone ever gets to see, as administrative jurisdiction at every level is presumed literally against everyone for litrally everything - whether is actually applies, or not.
But in this case, the judge (and notice he made a "dismissal" as part of his "ruling") didn't want it to appear that "the court" was actually letting someone "get away" with protesting against Muslims. So - voila' - he became an "administrative hearing officer."

Just because someone can do something, does that mean they should?
“Just because someone can do something, does that mean they should?”
Yeah, you’re right.
After spending the past eight days away from my home, taking care of my Mother’s house, health, affairs and everything else that a 92-year-old needs (after suffering a minor stroke three weeks ago) I return home to find three juveniles breaking into my home.
What can I do?
And, should I?
I’m on my own property.
Can I clear my cover?
Well, yes I can. And I did. And they ran screaming like little girls. All the way home to their parents.
Of course, the local PD showed up and had some questions for me.
“Do you have a permit?”
“Yes, but if you are familiar with the law, I don’t need one on my personal property”
“Can we see it?”
“Sure.”
“Did you brandish your weapon?”
“Nope, just adjusted my shirt.”
“Have a nice day.”
“Thank you, officer, you too.”
Because I can, I did.
A small, but valuable victory for free speech.
Protecting the ability to speak out against Islam is going to become increasingly important.
When it doesn’t involve an illegal posting on a pole regarding a lost pooch, it must be hate-speak.........
