A U.S. district judge granted a preliminary injunction Monday to stop federal funding of embryonic stem cell research that he said destroys embryos, ruling it went against the will of Congress.
The ruling by Judge Royce C. Lamberth was a blow to the Obama administration, which last year issued guidelines to allow federal funding for embryonic stem cell research.
Lamberth's ruling said all embryonic stem cell research involves destroying embryos, which violates the Dickey-Wicker Amendment included in federal spending bills.
"The Dickey-Wicker Amendment unambiguously prohibits the use of federal funds for all research in which a human embryo is destroyed," Lamberth's ruling said. "It is not limited to prohibit federal funding of only the 'piece of research' in which an embryo is destroyed. Thus, if ESC [embryonic stem cell] research is research in which an embryo is destroyed, the guidelines, by funding ESC research, violate the Dickey-Wicker Amendment."

Lamberth is one of the few decent judges left in the Federal Government.
Ask yourself this, EMBRYONIC STEM cell research is LEGAL in the PRIVATE sector, so WHY isn't the private sector going nuts over this?
BECAUSE they have had NO success in using embryonic stem cell research. The continuous success has been in ADULT stem cell research. Often they don't like to distinguish between the two.
EMBRYONIC stem cells are fertilized eggs. They are the same eggs used for IVF that if implanted will develop into little human beings. Dissecting EMBYONIC stem cells destroys little human beings.
Look for this to be added to the lame-duck cleanup agenda. Hope the Pubbies have the balls to bring the Senate to gridlock.

Royce C. Lamberth (born 1943) is a federal judge in the United States District Court for the District of Columbia.
Lamberth was born in 1943 in San Antonio, Texas. He graduated from the University of Texas and from the University of Texas School of Law, receiving an LL.B. in 1967. He served as a Captain in the Judge Advocate Generals Corps of the United States Army from 1968 to 1974, including one year in Vietnam. After that, he became an Assistant United States Attorney for the District of Columbia. In 1978, Lamberth became Chief of the Civil Division of the U.S. Attorneys Office, a position he held until his appointment to the federal bench.
He was nominated to the federal bench on March 19, 1987 by President Ronald Reagan, and confirmed by the United States Senate on November 13, 1987. He also served as Presiding Judge of the U.S. Foreign Intelligence Surveillance Court from 1995 to 2002.[1]
