Texas would have to preserve its current education spending levels through 2013 to qualify for more than $830 million in federal aid under a Texas-specific provision signed into law Tuesday by President Barack Obama.
The mandate passed the House on Tuesday afternoon as part of a $26 billion jobs protection bill, despite strong opposition from Texas Republicans. Several said the amendment unfairly singled out the state and jeopardized its ability to receive the funds.
Gov. Rick Perry said the provision, which applies only to Texas, is unconstitutional because state officials can't guarantee future spending. And only days after Lt. Gov. David Dewhurst threatened legal action over the requirements, Perry promised to "fight this injustice."

Well, the simple - and correct - response to this is for Texas to tell the Feds to keep their money.
Only when states are willing to do this, will they begin to break free from the ever-increasing tentacles of federal control.

sounds like yet another state will be filing suit against the federal government. sooner or later, you think that the “smart kids” in the white house would begin to scratch their heads simply over how much time it has to spend in court fighting it’s own states.
If this the first time the Bummer Rat-gress has pumped out some state specific shackles? I have deep dark doubts that it is.
Cynical me, I think they’re going to try a sympathy ploy out of this. Already in deep dutch with rednecks, the Bummer folks have pretty well written them off.

He's not...if you consider the states he's screwing with, AZ, TX, the lack of response after the TN flooding, the weak response in LA after the drilling rig blowout, all went R during the 2008 election..it might be payback.
Waiting to see how he's going to respond to the MO vote on Obanana care.
When we get a Republican president again, we should mandate that states must cut taxes to get federal funds :)
Reminds me of the National Minimum Drinking Age Act of 1984, where they threatened to withhold federal highway funds from any state that did not raise the age to 21.

He can’t constitutionally, but then again he also can’t constitutionally spend money on education.
Texas should simply refuses to allow Federal Taxes to be payed.
We should also add this to the list of impeachable offenses.
Of course, the same needs to happen all across the country. If even a few states passed such a law, the media couldn't ignore it, and the American people would take notice. So start petitioning your legislators, FReepers!

Actually, the amendment in question was authored a Texas Democrat.
I think they are trying everything they can to wreck the state budget/economy to make Perry look bad in order to give their "White boy" a chance.
I believe they would do just about anything to get a Dem as Texas governor.
