Mass. Senate enacts bill to replace Electoral College with popular vote

BOSTON — The Massachusetts Senate has enacted a bill that would give the state's Electoral College votes to the presidential candidate who wins the national popular vote.

The bill enacted by the Senate 28-9 Tuesday is part of a nationwide effort to secure the agreement of enough states so the winner of the national popular vote would be guaranteed to win the presidency.

The bill will now be sent to Gov. Deval Patrick, who has said in the past he supports the bill.

What a pack of disgusting oath breakers!

I wrote to my state senator, James B. Eldridge, and asked him: "If we can't trust you to keep faith with your own freely sworn oath (or affirmation) to uphold and defend the federal Constitution, then what can we trust you with?"

I await the senator's reply....

This "nationwide effort" of a cabal of states evidently thinks it can overturn Article II, Section 1, clause 2–4 of the federal constitution without the bother of having to go the Article V Amendment route — which the Constitution clearly requires for such sweeping changes in our basic rule of law.

This is totally sick-making....

I don’t believe they can do that - a law cannot violate the constitution and the college is constitutional.

Course look who did it. Mass should be ashamed.

A state can do whatever it wants with in-state elections, but it shouldn’t be able to change the federal election process without an appropriate amendment to the U.S. Constititution.

Massachusetts legislators (and governor, and Supreme Judicial Court) have no shame, edcoil. I say that with great sorrow in my heart — once upon a time, Boston was called "the cradle of Liberty." Today, Beacon Hill is run by a pack of feckless thugs.... There is no liberty left in Massachusetts that Gov. Patrick and his gang will not try to expunge sooner or later.

They are not the only one. The cabal is just trying to rack up enough states to equal 270 electoral votes, and they may well get there. If they do so,the electoral college is kaput unless the SC voids such laws. All we know is that it will be 5 to 4 one way or the other.

Take the abolishment of the electoral college, toss in amnesty for millions of illegal invaders, mix thoroughly, and you have a third world dictatorship.

James Taranto in the WSJ Best of the Web took the whole National Public Vote scheme apart and summarized it thusly: would Massachusetts really compel their electors to vote for Sara Palin in 2012?

Each state shall appoint, in such manner as the Legislature thereof may direct, a number of electors, equal to the whole number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or person holding an office of trust or profit under the United States, shall be appointed an elector.

Well, the Legislature clearly can do this. Obviously, though they are cutting off their nose to spite their face.

You have a second Obama term.... Then maybe after that he could get himself elected for life.... If they can bust the Electoral College, then why not just ignore the two-term constitutional limit on the president? Or maybe the same cabal of states will simply decide that limit is no longer relevant....

Its a joke. - I WANT to see what happens if Obama loses the popular vote, but needs Mass electoral votes to win.

There are dozens of such scenarios that would shake them to the ground.

I was thinking the same thing. I completely understand and agree with the unconstitutionality of what they’ve done and the future implications for other states and our country. But when a Republican wins the national popular vote, then the MA delegates gets assigned to the Republican party even if their state popular votes went Democrat?
So if I’ve gleened enough information from articles, they really don’t care about their own populace of MA for whom they were elected to serve, but they want to be some shining star of unconstitutionality for the country leading the way for the country to be forced into popular vote.

Kind of reminds me of them leading the way on healthcare
