Inmate sues man he’s convicted of burglarizing

A Florida inmate is suing the man he’s convicted of burglarizing, claiming the man and two others roughed him up during a citizen’s arrest. Michael Dupree is serving a 12-year sentence for burglary and cocaine possession stemming from a 2007 break-in of a van in St. Petersburg. Dupree allegedly stole a bicycle locked inside and was apprehended after the owner, Anthony McKoy, saw him with the bike down the street.

Dupree said McKoy and two others pointed a gun at him, handcuffed him and placed a knee painfully in his back. He’s seeking $500,000 for disabilities and distress suffered during the takedown.

Next time, I hope that the “victim” just calls the Coroner and saves everybody the headache.

I know that’s my plan of attack.

LOL, this suit is just so the inmate has something to do - - like a bus trip to a courtroom.

No jury in the US, not even OJ’s, would allow this to find its mark.

The court system makes money, the lawyers make money, and everybody's happy.

Except the victim, who go victimized again.

He should be thanking his lucky stars that being roughed up is all he got. This is the kind of crap that you get from the prisons, where legal representation is free and the dirtbags have nothing to do all day but sit and dream up lawsuits.

Dupree filed the civil lawsuit on his own, without the help of an attorney.

May I suggest that next he sue the maker of the bicycle for not having the necessary qualities to allow him to petal fast enough to avoid being caught?

Exactly. Inmates file frivolous lawsuits all the time. What else have they got to do? That such a lawsuit was filed isn't really newsworthy. If it goes to trial, then we'll have something to talk about.

My daughters neighbor heard someone breaking into his bathroom.
He pulled him into the house, beat him up, and stuffed him back out the window.

So these guys just happened to have hand cuffs with them when they captured this petty criminal.

I know that they are available to civilians. But few civilians buy them and fewer carry them around.

If I were a a judge or juror on this case He would need physical proof of injury and proof that it happened at the time of his capture by the actions Dupree said McKoy.

He would also need to prove that the injuries were not the result of his resistance to arrest.
