Reid claims First Amendment protection, re-launches old Angle website

Nevada Democrats today re-launched their version of GOP senate candidate Sharron Angle’s old campaign website.

Senate Majority Leader Harry Reid’s campaign yanked the website over the weekend after Angle’s lawyers sent a cease and desist letter, claiming Reid abused “proprietary materials” from Angle’s old site.

This afternoon, however, the Nevada Democratic Party put the site back up, claiming protection under the First Amendment.

“Out of an abundance of caution, the Reid campaign decided to temporarily remove the website in question while we investigated their allegations,” the Reid campaign said in a press release this afternoon. “Well, the phony legal threats and the feigned indignation are over — and we're not going to let Sharron Angle retroactively censor Sharron Angle.

"They've copied the original Angle website, and basically reposted it under the auspices of "The Nevada State Democratic Party."

So their explicit and stated purpose is to put up the original Angle website just as it existed before, at least as far as the about, positions and endorsements pages."

Generally speaking, unless something has been copyrighted, you're able to copy it and repurpose it. The 1st Amendment is robust in this regard, or so the Court has held. As I said, absent problems with respect to the campaign finance laws, I don't believe an injunction would be granted.

It’s ironic that Reid would cite Amendment I considering that it’s sole purpose is to protect the people from Congress.

Correct. Except that the main point won’t be to intimidate voters. That’s just a bonus of secondary importance. The thugs will be out with the primary intent of SCARING OFF AND DRIVING AWAY POLL WATCHERS, especially from “certain” highly corrupt urban precincts, so that vote fraud, on a locally massive scale, can proceed.

If that is the case, Stultis, I should think Patriots would already be planning countermeasures to “escort” the good people of Nevada to the polls to vote safely — and to notify the authorites in the meantime to come and deal with the various Thugs that attempt to intimidate or hinder them...?

MIght I be so bold as to suggest, for any readers out there in Nevada, that there are particular folks, with particular builds and often dressed in particular uniforms or other identifiable costumes/gear that would leave an indelible impression upon those who might try to hinder voters on their way to the polls...? I’m just saying....

I like the old site.

Somehow I don’t think that this is going to work for the RAT party.

Yeah. It doesn't really work like that. First, they have the media on their side. So you'll give them the opportunity to turn the blame on us. The "escorts" will be treated as the violators.

You can't go thug on thug. You have to send lawyers, or some kind of guys in suits. But the problem even then is, no matter how good your organization, sometimes the poll watchers will get run off before your team even has time to get to the polling station.

For example, one of the witnesses testifying in the New Black Panthers Party case, noted that even before that particular event, there had already been poll watchers run out of other precincts that day. Here's some of the testimony from that hearing:

MR. [Bartle] BULL: Yes. I was in a car, driven by a young volunteer, with another volunteer from New York. And we were receiving cell phone messages, saying that in many, many polling places, there was intimidation. Not so much of voters, Mr. Melendez, but intimidation of poll watchers. A very important point, sir, if I may say.

And that was what was going on. Our poll watchers were driven out of the polls in five or six places I went to. And while we were examining those situations, we had a call on the radio -- on the cell phone, excuse me, saying that on -- on -- at Fairmount Street, there were two Black Panthers intimidating voters and poll watchers, as you just heard.

So, we drove there, and there indeed we saw the two Black Panthers, blocking the door to a polling place, one of them armed with a weapon. I may say in my many years as a Civil Rights lawyer -- I didn't mention that. You asked me that question, I'm sorry. I also worked for a group called the Lawyer's Committee for Civil Rights Under Law in Mississippi. In 1966, I took my summer vacation as a lawyer; went down to Hattiesburg and other towns in Mississippi, and worked as a Civil Rights lawyer there. And even there, I never saw armed people blocking the doors to a polling place.

No, she shouldn’t, but WE should send her some cash.

I’ve been asked for contributions from every Republican running this year. I can’t donate to all of them, but Angle I will. Getting rid of Hairy Reed can be nothing but good for our country, and all of us!

I don't mean to be rude, but I do wish Sharon would STFU!!! She needs people to tell her what to say.. I was agonizing today on Hannity.. she needs to stop the "cute" buzz words and get down to business... I am voting for her, only because I have to..

Now, it is not that I don't agree with what she says, it is that , I keep running into Seniors that think she wants to take their social security!

As hard as I try I can't make them get it!

Reid has framed this issue and it kills me to her her speak.. I honestly like the woman, but she really needs some better people advising her!!!

He is going to find out what copyrigth law is since they already sent a cease and desist letter. Next step is for them to sue.

That depends on whether Angle had the content registered with the U.S. Copyright Office. Copyright without registration is a toothless beast.

There are no first amendment rights as far as copyright goes.

Sure there is...fair use is just one example.

...and yes...I do think Reid is a putz who should be tarred and feathered on his way out of office.

Angle should do something very simple.

1. Buy billboards across Nevada.
2. On every Billboard is a picture of Reid swimming in money.
3. The tagline is: Nevada is at 15% unemployment and you are swimming in cash. Thanks Harry Reid.
4. Every campaign stop the message stays the same. HARRY REID IS THE REASON WHY NEVADA HAS 15% UNEMPLOYMENT.

Who will she sue next? The Wayback Machine internet archives? They have copies of all her pages going back to 2004.

Nothing ever dies on the internet. I hope she and her people understand that.
