Byrds current term expires on January 3, 2013. Under West Virginia state law on handling Senate vacancies, if the vacancy occurs less than two years and six months before the end of the term, the Governor appoints someone to fill the unexpired term and there is no election. Otherwise, Manchin would appoint an interim replacement, and an special election would be held in November to determine who held the seat in 2011 and 2012.
In other words, we are within a week of the threshold established by West Virginia law. If a vacancy were to be declared on July 3rd or later, there would not be an election to replace Byrd until 2012. If it were to occur earlier, there could potentially be an election later this year, although there might be some ambiguities arising from precisely when and how the vacancy were declared.
What a bunch of cr@p. Vote the turd out and at least get a new fresher smelling turd in.
I’m sure JD has made mistakes, and is not perfect - but he STILL cannot come close to what McCain has done to this country.

The National Review follows the Chamber of Commerce lead on illegal immigration, including amnesty for the 20 million cheap workers. That’s why they see no problems with McCain, just like in 2007.

McCain supports amnesty, which will destroy this country with the stroke of a pen. He has been bought by corporate interests. He voted for TARP. The National Review represents the GOP establishment. If we are ever going to get this country back, the conservatives must take back the GOP or failling that, form a third party.

And their criticism of JD Hayworth is about as weak as could be. They somehow failed to mention that Juan McCain's senate website contained information on obtaining government grants, and that he voted for biggest collection of earmarks in US history: the bailout bill.
Cronyism over principle, just like a collection of other old establishment Republicans who support Juan, but have claimed to oppose him on major issues.
