White House: Obama may use executive privilege to withhold Kagan documents

In a letter to Sen. Jeff Sessions, the ranking Republican on the Judiciary Committee Republican, Robert Bauer, counsel to Obama, implied the president may use executive privilege to hide some memos Elena Kagan wrote when she served in the Clinton White House.
President Obama does not intend to assert executive privilege over any of the documents requested by the Committee, Bauer writes.
Of course, President Clinton also has an interest in these records, and his representative is reviewing them now, he adds.
The Clinton library has more than 150,000 documents related to Elena Kagan. This is one of the few sources we have to know what Kagan thinks on many issues.

How exactly is Clinton going to withhold documents?
Did you forget the sarcasm tag? This question operates under two very bold presumptions. One: Bubba is interested in the law. Clearly he is not burdened by such a conscience. Two: Anyone in a serious position of power would call him on it. Issa might. Palin might. Cheney might. The entire left would cheer him as their champion restored to his sordid "glory."

-- too bad for Nixon's legacy, that's the kind of squishy liberalism that Nixon & co. were all too prone to embrace ... even if ....like GW Bush.... Nixon was so loathed by many fellow liberals. The greatest title history can bestow is
DEFENDER OF FREEDOM!!
If that also results in a lasting peace in the near term then so very much the better -- but this idea of "peace" above all else is the kind of squishy pseudo-idealism which sounds nice but frequently leads to subservience before the vicious enemies of freedom (whether communist or Islamist or fascist or combinations thereof). It's ALWAYS possible to have "peace" on the terms of the enemies of freedom.
