Kagan Can Be a Justice, Though She’s Never Been a Judge?

President Obama has selected Elena Kagan, the solicitor general of the United States, as his nominee to replace the retiring Justice John Paul Stevens. From her official bio: Kagan came to Harvard Law School as a visiting professor in 1999 and became Professor of Law in 2001. While on the faculty, Kagan taught administrative law, constitutional law, civil procedure, and seminars on issues involving the separation of powers. She was appointed Dean of the Law School in 2003. Aside from employment as an associate in a law firm, her functions before becoming the solicitor general were primarily academic, and later administrative. The closest she ever came to getting judicial experience came when she served as a law clerk to Judge Abner Mikva of the Court of Appeals for the D.C. Circuit from 1986 to 1987, and as a law clerk to Justice Thurgood Marshall of the Supreme Court the next year.

It strikes me that judicial experience is of utmost importance. She lacks it and the Supreme Court is not a good place for on-the-job training.

She can if she gets 41 Republican Senators to vote yes. Imagine if a republican tried this.

Administrative law is generally considered a lightweight subject. And even at that she’s published next to nothing. She appears to be a gifted academic politician, but that’s about it.

The last justice to join the court without being a judge was William Hubbs Rehnquist who evertually became Chief Justice.

The last Supreme Court Justice confirmed without Judicial experience was William Rhenquist...almost 40 years ago.

The Constitution requires no law degree or experience for a SCOTUS justice.

However, the Constitution does require a POTUS to be native born. The real issue is how long before this imposter is removed?

Personally, I’d rather have some non-judge, non-lawyer types on the SCOTUS.

William Rehnquist hadn't been a judge before being named to the Supreme Court and he didn't turn out too bad.
