Natural-Born Citizen per Justice Ginsberg?

On this basis, at the very best, Barack Hussein Obama II could be a “14th Amendment Citizen”—a naturalized “dual” citizen with “divided” national loyalties. He cannot hold the office of president or vice president.

This means that Barack Hussein Obama is NOT eligible for the office of president, and is therefore, an imposter, a fraud and a usurper of the U.S. Constitution. It also means that everyone in Washington DC is aware…and complicit in the greatest fraud ever perpetrated on U.S. citizens and the world.

Obama’s Department of Justice will never allow a single case over Obama’s eligibility to enter a courtroom, rushing DOJ lawyers around the country to file dismissals for Obama, based on “a lack of standing” on the part of U.S. citizens.

Too late. Since he is the president right now it´s too late.
Even if true this will never (or at least only years later after his therm ended) come to “daylight”.
Thank god we don´t have this law here in my country.
There is no citizenship by birth.

Actually, I believe everyone is pretty well agreed that at the time of the Constitution the father’s citizenship only mattered. This is because under the law at the time when a couple wed they quite literally became legally “one person,” with the woman disappearing legally as long as she was married.

So an alien woman marrying an American immediately became an American, while an American who married a Brit instantly became British.

All these rules and laws changed as we gave women equal rights and I seriously doubt you could get any court to consider your argument. Nor should it. Men and women are equal under the law, and the Constitution, now.

It became apparent to a significant number of Americans when the entire Congress, including tough-talking Republicans, Rinos and Dems, sat on their hands during the January 2009 Joint Session that accepted Obama?’s electoral votes.

The nation would have been perhaps in an only slightly better fix with that “little Marxist” Hillary, but at least she was legal.

Did this guy even read the entire transcript from the oral arguments in that case? Ruth Buzzie goes on to say that she believes her grandson, who was born in France to American parents is a natural-born citizen, which is about as "liberal" with that phrase as one can get. Most scholars believe that birth on US soil is a requisite for natural-born status. Ruth Buzzie doesn't, clearly...

I know that the Solicitor General took the line in its brief that there are only two kinds of citizens... born in the United States, and everybody else for constitutional purposes is naturalized.

My grandson was born in Paris of U.S. citizen parents.

I had never considered him a naturalized citizen of the United States, but is that his correct status?

I´m not talking about the generall people i´m talking about the “people” in power. He is in power since 2 years and he will be in power for at least 2 years on (if nothing different happens because “this” will not happen)

The argument you quoted and the one cited in the article go hand in hand. Ginsburg argues, and I think she is correct, that “natural born” citizenship is conferred by blood, not by birth. The fourteenth amendment confers citizenship by birth to those born in the United States, but that doesn’t change the original definition of “natural born” citizen.

James Madison, a guy who knew a little about the Constitution wouldn't agree, or at least he didn't In a speech before the House of Representatives in May of 1789...

"It is an established maxim, that birth is a criterion of allegiance. Birth, however, derives its force sometimes from place, and sometimes from parentage; but, in general place is the most certain criterion; it is what applies in the United States."

It appears that Ginsberg contemplates only two types of U.S. citizenship to go with the two ways of gaining citizenship that Scalia outlined.

As much as I despise the judicial outlook of Ginsberg, this was my view of the law, and has been for long before Ginsberg opined on the subject or 0bambam made the scene.

Either one is born a citizen and is thus a “natural born citizen” or one is naturalized as a citizen and is thus a “naturalized citizen”.

True! Very true.

We need to work hard to get a more conservative Congress in November 2010. Then that Congress can marginalize and minimize him.

One thing Congress has never done and should start is to write laws overruling Presidential Executive orders. That and write laws better so policy decisions were made in the law or not allow say the AG to determine what he/she can do. Congress needs to say this is it do not deviate.

I know, will never happen.
