A sophisticated bomb would not have smoked before detonating, giving no warning.

Hmmm ... sounds like something out of the old Anarchist's Cookbook, that has also likely been adapted into the Al Queda Terrorism Handbook. Simple to make and put together; if paid for in cash, relatively hard to trace as all components can be purchased OTC and not tracked.

A similar device also failed to detonate in the "Columbine High School massacre" in 1999:

Washington, D.C. ~ Thursday, May 6, 2010

Good morning Chairwoman Mikulski, Ranking Member Shelby, and distinguished members of the subcommittee. Thank you for this opportunity to discuss the President’s Fiscal Year 2011 Budget for the Department of Justice and to provide an update on the department’s progress, key priorities and future plans. I appreciate your recognition of the department’s critical mission, and I look forward to your continued partnership and support.

When I appeared before this subcommittee last May, I set forth several goals for the department: to protect our nation’s security, to reinvigorate the department’s traditional missions, and to restore integrity and transparency at every level of the department’s work. I also pledged that, under my leadership, all decisions and policies would be based on the facts, the law and the best interests of the American people, regardless of political pressures or political consequences.

Almost one year later, I’m pleased to report that the department has made historic progress in meeting these goals. Although new challenges and demands have emerged, the thousands of men and women who serve the department have advanced efforts to protect our country, to enforce our laws in a non-partisan manner, to defend our interests in court, and to ensure the strength and fairness of our justice system.

The President’s FY 2011 Budget request for the Department of Justice, which totals $29 billion and includes $2 billion in program enhancements, will enable the department to build on the progress that’s been achieved over the last 15 months. During this time, we’ve enhanced our national security programs and capabilities. We’ve strengthened efforts to support our most vulnerable communities, to safeguard civil rights in our workplaces, housing markets, voting booths, and border areas, and to protect our environment. In light of last week’s oil spill in the Gulf of Mexico, I want to note that the Justice Department stands ready to vigorously enforce the laws that protect the people who work and reside near the Gulf, the local wildlife, the environment and the American taxpayers. I recently dispatched a team of attorneys to New Orleans to monitor the oil spill, and the department will continue to provide critical legal advice and support to the agencies involved in the federal response.

As part of our focus on securing our economy and combating mortgage and financial fraud, the department is now spearheading the Financial Fraud Enforcement Task Force that President Obama launched last year. And, in collaboration with the Department of Health and Human Services, we’ve made meaningful progress in combating and deterring health care fraud through the Health Care Fraud Prevention and Enforcement Action Team. Through this initiative, we have brought the full resources of our agencies to bear against individuals and corporations who illegally divert taxpayer resources for their own profit. Just last week, this work resulted in a $520 million settlement – the largest amount ever paid by a company in a civil-only settlement of off-label pharmaceutical marketing claims. And, over the past 15 months, the Justice Department has recouped more than $2.8 billion in health care fraud cases through use of the False Claims Act, money that will be fed back into federal coffers.

The President’s budget request will enable the department to build on these achievements and to continue making progress in meeting its responsibilities. Let me assure you that, in distributing and using these funds, we will think carefully and strategically. And we will act to ensure accountability and transparency, just as we have in managing the billions of dollars that have recently been recovered.

The investments requested in the President’s Budget would allow us to continue aggressively pursuing and prosecuting financial and health care fraud, to expand the Community Oriented Policing Services (COPS) hiring program, to reduce violent crime and drug trafficking, to assist our state, local and tribal law enforcement partners, to ensure that detention programs are adequately funded and that effective prison and jail re-entry programs are available, to protect civil rights, to combat international organized crime, and to enforce immigration laws. As you all know, the Department is currently working with agencies across the federal government, and with Congress, to support comprehensive immigration reform in a way that “keeps faith,” as President Obama has said, “with our heritage as both a nation of immigrants and a nation of laws.”

The budget would also allow the department to strengthen its critical national security work. As you’ve seen, $300 million in program increases have been requested to help strengthen national security and to counter the threat of terrorism. These resources will enable us to expand on the progress we’ve made in the last year. Due to the vigilance of our law enforcement and intelligence agencies, we’ve succeeded – repeatedly – in identifying and averting nascent plots.

On Monday, Faisal Shahzad, a naturalized U.S. citizen born in Pakistan, was arrested in connection with his alleged role in last Saturday’s attempted car bombing in Times Square. On Tuesday, he was charged with acts of terrorism transcending national boundaries, attempted use of a weapon of mass destruction, and other federal crimes. If convicted, he faces a potential life sentence in prison.

During ongoing questioning by federal agents, Shahzad has provided useful information, and we will continue to pursue a number of leads as we gather intelligence relating to this attempted attack. Although this car bomb failed to properly detonate, this plot was yet another reminder that terrorists are still plotting to kill Americans. In February, Najibullah Zazi, a key participant in the plot to bomb New York City’s subway system, pleaded guilty to terrorism violations. Less than two weeks ago, we secured another guilty plea from one of Zazi’s co-conspirators and revealed the role of senior al-Qaeda leaders in ordering the plot. Three others also have been charged as a result of our investigation.

These attempted attacks are stark reminders of the threats that we, as a nation, confront. For the Department of Justice and our partners in the national security community, there is simply no higher priority than disrupting potential attacks and bringing those who plot them to justice. In the Shahzad and Zazi cases, that is exactly what the dedicated federal agents, law enforcement officers and Justice Department prosecutors achieved through exemplary investigative efforts. It is in every American’s best interest to ensure that these public servants have the resources necessary to continue their outstanding work.

In this time of unprecedented challenges, new threats, and ongoing war, your support will continue to be critical in helping the department meet its goals and obligations. As we move forward, I look forward to working with you as all. Once again, thank you for inviting me here today. I am now happy to answer any questions you may have.

Faisal Shahzad Indicted for Attempted Car Bombing in Times Square

WASHINGTON—A federal grand jury in the Southern District of New York has returned a 10-count indictment charging Faisal Shahzad for allegedly driving a car bomb into Times Square on the evening of May 1, 2010, the Justice Department announced today.

Shahzad, 30, a naturalized U.S. citizen born in Pakistan, was taken into custody at John F. Kennedy International Airport (JFK Airport) on May 3, 2010, after he was identified by the Department of Homeland Security’s U.S. Customs and Border Protection while attempting to leave the United States on a commercial flight to Dubai. Shahzad was then charged in a five-count criminal complaint. On May 18, 2010, he was presented in Manhattan federal court before U.S. Magistrate Judge James C. Francis, IV.

The case has been assigned to U.S. District Judge Miriam Goldman Cedarbaum of the Southern District of New York. Shahzad is expected to be arraigned by Judge Cedarbaum on June 21, 2010, at noon.

“The facts alleged in this indictment show that the Pakistani Taliban facilitated Faisal Shahzad’s attempted attack on American soil,” said Attorney General Eric Holder. “Our nation averted serious loss of life in this attempted bombing, but it is a reminder that we face an evolving threat that we must continue to fight with every tool available to the government.”

According to the indictment filed today and the criminal complaint:

In December 2009, Shahzad received explosives training in Waziristan, Pakistan, from explosive trainers affiliated with Tehrik-e-Taliban, a militant extremist group based in Pakistan. On Feb. 25, 2010, Shahzad received approximately $5,000 in cash in Massachusetts sent from a co-conspirator (CC-1) in Pakistan whom Shahzad understood worked for Tehrik-e-Taliban. Approximately six weeks later, on April 10, 2010, Shahzad received an additional $7,000 in cash in Ronkonkoma, N.Y., which was also sent at CC-1’s direction.

On March 15, 2010, Shahzad purchased a semi-automatic 9 millimeter Kel-Tec rifle in Connecticut. This rifle was found, loaded, in Shahzad’s car on the day of his arrest.

In April 2010, Shahzad contacted the seller of a Nissan Pathfinder after seeing an advertisement posted on a website. Thereafter, on April 24, 2010, Shahzad and the seller of the Pathfinder agreed to meet in a supermarket parking lot in Connecticut, where Shahzad paid the seller $1,300 for the Pathfinder. In April 2010, Shahzad also purchased components for the improvised explosive and incendiary devices that he loaded into the Pathfinder on May 1, 2010.

On May 1, 2010, Shahzad drove the Pathfinder, loaded with the improvised explosive and incendiary devices, to Manhattan and parked the Pathfinder in Times Square in the vicinity of 45th Street and Seventh Avenue. After parking the Pathfinder, Shahzad attempted to begin the detonation process of the improvised explosive and incendiary devices. Thereafter, Shahzad abandoned the Pathfinder and returned to his residence in Connecticut.

On May 3, 2010, Shahzad drove from Connecticut to JFK Airport as he attempted to flee to Dubai. He was arrested later that same day at JFK. After his arrest, Shahzad admitted that he had recently received bomb-making training in Pakistan. He also admitted that he had brought the Pathfinder to Times Square and attempted to detonate it.

The indictment filed today charges Shahzad with 10 offenses which carry the following potential penalties:

Count 1 – Attempted use of a weapon of mass destruction, life in prison.
Count 2 – Conspiracy to use a weapon of mass destruction, life in prison.
Count 3 – Possession of a firearm during and in relation to a conspiracy to use a weapon of mass destruction, life in prison.*
Count 4 – Attempted act of terrorism transcending national boundaries, life in prison.
Count 5 – Conspiracy to commit an act of terrorism transcending national boundaries, life in prison.
Count 6 – Attempted use of a destructive device during and in relation to a conspiracy to commit an act of terrorism transcending national boundaries, life in prison.*
Count 7 – Transportation of an explosive, 10 years in prison.
Count 8 – Conspiracy to transport an explosive, 10 years in prison.
Count 9 – Attempted destruction of property by fire and explosive, 20 years in prison.*
Count 10 – Conspiracy to destroy property by fire and explosive, 20 years in prison.*

* Counts three, nine and 10 each carry a mandatory minimum penalty of five years in prison. Count six carries a mandatory minimum penalty of 30 years in prison. If there are convictions for counts three and six, a sentence of life in prison is mandatory.

U.S. Attorney Preet Bharara stated: “Today’s 10-count indictment returned in the Southern District of New York charges Faisal Shahzad with conspiring with the Pakistani Taliban to wreak death and destruction in Times Square. This office will continue to work in lock-step with our partners at the FBI and the NYPD to protect New York City from the threat posed by terrorists and those who would support them.”

FBI New York Acting Assistant Director-in-Charge George Venizelos stated: “Today’s indictment of Faisal Shahzad is a major step in this important investigation. Shahzad was allegedly ready to commit a horrendous crime in the heart of New York. The FBI’s Joint Terrorism Task Force (JTTF) quickly went into high gear to identify and arrest Shahzad. We will not let our guard down as we work to protect our city, our citizens, our visitors and our country.”

“Today’s indictment is a stark reminder that New York remains a terrorist target and that we must be vigilant to protect the City,” said Raymond W. Kelly, the Police Commissioner for the City of New York.

The indictment was the result of the investigative efforts of the FBI’s JTTF in New York, Connecticut, and Massachusetts, especially those JTTF members from the FBI and the New York City Police Department. U.S. Customs and Border Protection also made significant contributions to the case. Substantial assistance was also provided by the Justice Department’s National Security Division, as well as the U.S. Attorney’s Offices for the Districts of Connecticut and Massachusetts.

The prosecution is being handled by Assistant U.S. Attorneys Brendan R. McGuire, Randall W. Jackson, John P. Cronan and Jeffrey A. Brown of the Terrorism and International Narcotics Unit in the U.S. Attorney’s Office for the Southern District of New York.

The charges and allegations contained in the indictment are merely accusations and the defendant is presumed innocent unless and until proven guilty.

CAIRO – The man who pleaded guilty to carrying out the attempted Times Square car bombing vowed in a video recorded before the failed attack that he would strike the U.S. to avenge the deaths of Muslims killed by American forces.
The Dubai-based television station Al-Arabiya broadcast excerpts Wednesday of a 40-minute video featuring Faisal Shahzad that it said was released by the Pakistani Taliban. The station did not say how it got hold of the video.

In excerpts aired on Al-Arabiya, Shahzad is sitting on the ground in a black turban and military fatigues, with a gun next to him as he recites verses from the Quran.

He says he will carry out a “revenge attack” against the U.S. to avenge the deaths of Muslims killed in Afghanistan and Pakistan by the U.S., and that he hopes his actions will touch the hearts of Muslims.

New footage has emerged showing the Times Square bomber Faisal Shahzad meeting the leader of the Pakistani Taliban, Sky News reported Friday.

It shows Shahzad and Hakimullah Mehsud shaking hands and hugging sometime before the failed attack in New York on May 1.

During the video, Shahzad’s voice was also heard.

He said: “Today, along with the leader of Tehrik-e-Taliban Pakistan Hakimullah Mehsud and under the command of Amir al-Mumineen Mullah Mohammed Omar Mujahid (may Allah protect him), we are planning to wage an attack on your side, inshallah.”

Last month, in a statement read out in a U.S. court, Shahzad admitted receiving training in Pakistan about how to “wage an attack” in America.

The 30-year-old defendant admitted: “How to make a bomb, how to detonate a bomb.

“I asked them (the Taliban) for some cash because I only had — my cash was like $4,500 that I had with me when I was leaving.

“And I asked for some more cash because I had to do the whole operation here.”
