Army: Not seeking death for Hasan

But Hasan's attorney accuses Army of stonewalling

BELTON, Texas (KXAN) - The U.S. Army said it is not actively seeking the death penalty against the man accused of the Fort Hood shooting in November.

Yet, Maj. Nidal Hasan's attorney insists the Army is making every effort to have Hasan executed by lethal injection.

Hasan has been at the Bell County Jail under 24-hour surveillance since April 9, and his attorney is pushing to have him moved to Fort Hood Medical Center because he said the jail isn’t equipped to deal with his medical needs.

Hasan is paralyzed from being shot during the Nov. 5 shooting, which killed 13 people on post.

Still, attorney John Galligan said his biggest concern is that the Army is fighting to conceal records. He said there is no way Hasan can get a fair trial because they are not considering him innocent until proven guilty.

"I think you would have to be blind and an idiot to not know and see what's going on at Fort Hood,” Galligan said.

Galligan said the Army has already taken several steps to ensure Hasan will face the death penalty, despite a statement just released that said: "Fort Hood officials want to stress that there has been no decision to pursue the death penalty in the case against Major Nidal Hasan."

Hasan faces 13 counts of premeditated murder and 32 counts of attempted premeditated murder after the November shooting rampage.

"It's pretty much a sure-fire thing this will be tried as a death penalty case,” Galligan said.

He needs to be dragged by the neck to his place of execution where he gets a long drop on a short rope.

First, the "shooting" didn't kill them. Hasan did.

Second, there were 14 people killed. One of the soldiers was expecting.

No. It's not trial counsel who seeks the DP, per se. It is the convening authority, who then instructs the TC to charge the requisite aggravating factors. Without such instruction from the convening authority, it is not permissible to issue a sentence of death as it's not a capital case.

The verdict must be unanimous in a DP case, and it's actually the President himself who approves death. After such approval is giving, the defendant has one last appellate option available, and that is to the SC. As an example, while the last person executed happened on Kennedy's watch, that man's execution was approved not by Kennedy, but by Eisenhower. Of course, it was within Kennedy's purview to commute or pardon. He elected to do neither. Bush was the next president to sign a death order, and that execution is pending final appeal to the SC.

Incidentally, the TC in Hassan's case, just notified his attorney that they were alleging those aggravating factors.

I'm a death penalty advocate. In fact I'd volunteer to do the injection to most of these miscreants. But thinking of him sitting in a crappy chair, getting stasis ulcers, urinary tract infections, bowel obstructions, and having FEMALE nurses handle him like a sack of manure as they "treat" him....

well, I don't know. I think a nice little ride in prison as he's put away and forgotten too rot like a beached fish is justice. He will NOT BE GIVEN THE PRIVILEGE of giving his life to Allah (piss be unto him), he won't be a martyr, just a pathetic, paralyzed lump of flesh that will be looked upon with disgust, pity and hatred for the rest of his pathetic life.

Or you could just dump him over in a room full of hungry dogs and come back in a week. Either way, I would rather never hear this pathetic losers name ever again.

The Army and most of the military bases are just idiotic with the "PC" no weapon policy. He might have killed 2-3 but if everyone had a weapon, he would have died at the scene and everyone knows it, including the commanding officers and civilian "authorities" in the chain of command.
