Army: Not seeking death for Hasan
KXAN ^

But Hasan's attorney accuses Army of stonewalling

BELTON, Texas (KXAN) - The U.S. Army said it is not actively seeking the death penalty against the man accused of the Fort Hood shooting in November.

Yet, Maj. Nidal Hasan's attorney insists the Army is making every effort to have Hasan executed by lethal injection.

Hasan has been at the Bell County Jail under 24-hour surveillance since April 9, and his attorney is pushing to have him moved to Fort Hood Medical Center because he said the jail isn’t equipped to deal with his medical needs.

Hasan is paralyzed from being shot during the Nov. 5 shooting, which killed 13 people on post.

Still, attorney John Galligan said his biggest concern is that the Army is fighting to conceal records. He said there is no way Hasan can get a fair trial because they are not considering him innocent until proven guilty.

"I think you would have to be blind and an idiot to not know and see what's going on at Fort Hood,” Galligan said.

Galligan said the Army has already taken several steps to ensure Hasan will face the death penalty, despite a statement just released that said: "Fort Hood officials want to stress that there has been no decision to pursue the death penalty in the case against Major Nidal Hasan."

Hasan faces 13 counts of premeditated murder and 32 counts of attempted premeditated murder after the November shooting rampage.

"It's pretty much a sure-fire thing this will be tried as a death penalty case,” Galligan said.

Just put him outside on the sidewalk. Let him go free.

I'm sure public spirited citizens would figure out what must be done if the Army can't.

Hey, do they allow soldiers to carry guns at Fort Hood yet?

If this case doesn’t deserve the death penalty, nothing does. And if execution wouldn’t send a message to similar freaks, what would?

No matter how many times I read this I still wonder "WHY NOT"?

If I remember correctly, he could be sentenced to life at hard labor.

In a military prison, that sentence is exactly what it says it is. He would be reduced to E-1, forfeit all privileges and pay, and have to work hard every day until he drops dead.

Frankly, I like the sound of that better.

I certainly am not in favor of death. He is paralyzed. I think life without pain medication would be just fine as a sentence.

The death penalty fits the crime.

But living as a paralytic for maybe decades...now that goes with the
old saying of “payback is a b-tch”.

Simply remove him from the post and turn him over to a few seasoned non-coms. Guys who understand loosing friends in battle. Seem only fair, but will not happen.

Me too. He *wants* to be executed I'd wager so he can get his 72 virgins. Dealing with his paralysis alone is probably pretty good torture for him. In the male-domination world of Islam, losing the use of your "stuff" is pretty darn good punishment.

I think you have to be blind and an idiot to think he isn't guilty and doesn't deserve to die.

Where is Black Jack Pershing when you need him?

If retribution were the purpose of the death penalty, that would be a perfect solution.

You know, as an Army vet and the father of a 4X Iraq vet, i’d just like to say that over the past 40 years, the impression I’ve had is that while or troops should be respected, the military lawyers are a pretty scummy lot.

It seems he had the ability to seek death of those 13 in the military; why not death for him/

I think it’s possible that the boys at the Pentagon are afraid that the “immigration” rent-a-mob have an off day on Sunday and might show up at the Pentagon chanting “Racists!” at the walls of the Pentagon.

Some of us think that’s just one of several perfectly valid purposes. YMMV.

In a court martial if the prosecution doesn't seek the DP in a case where it could be imposed does the judge and/or jury have the power to impose it anyway? Any lawyers out there?
