KNOXVILLE - Federal court jurors reported today they have reached a verdict on three of four charges against former University of Tennessee student David C. Kernell, accused of illegally accessing the private e-mail account of 2008 GOP vice presidential candidate Sarah Palin.
But they also reported they are deadlocked on the first count, a charge of identity theft.
Without asking what their verdict is on the other counts, U.S. District Judge Thomas W. Phillips sent them back to the jury room to continue deliberating the first count.
In their written communication to the judge this afternoon, the jurors said: "Some of us feel not all jurors are following the jury instruction."
On its third morning of deliberations, the East Tennessee jury pondering charges against Kernell asked to review a federal law addressing identity theft. That's the count on which the jurors deadlocked.
After some discussion with lawyers, Phillips decided today to give them a copy of the law - with some sections blacked out that he said are irrelevant to the case.
Jurors then indicated they wished to go to lunch. The panel is expected to resume deliberations at 1 p.m. today.

Juror Pay
Federal jurors are paid $40 a day. While the majority of jury trials last less than a week, jurors can receive up to $50 a day after serving 30 days on a trial. (Employees of the federal government are paid their regular salary in lieu of this fee.) Jurors also are reimbursed for reasonable transportation expenses and parking fees. Jurors also receive a subsistence allowance covering their meals and lodging if they are required to stay overnight.
Your employer may continue your salary during all or part of your jury service, but is not required to do so. Nonetheless, the Jury Act forbids any employer from firing, intimidating, or coercing any permanent employee because of their federal jury service. You should check whether your company or employer has a policy for employees serving on jury duty.
So, the range of possible sentences, if found guilty, is from 0 to 50 years?
I bet he gets no jail time.

If an element of the crime of "speeding" is "doing damage," and you didn't do any damage, then you weren't "speeding" under the law.

However isn’t it true that nullification of law is a jury authority well based in history which has been usurped through judges instructions over the years?
That’s up to the judge to decide sentencing.
A juror’s job and sworn obligation is to decide innocence or guilt, nothing more.
And just how many times did the instructions include the fact that there are US Supreme court decisions stating that the jury is the judge of both the facts and the LAW?

If you are on a federal jury and live far enough away that they put you up in a hotel (actually give you a flat amount, you can net out about $150/day if you find a reasonably priced hotel and keep your meal expenses down.
Did you think about how your guilty vote would affect him after you considered the evidence beyond a reasonable doubt that he beated his wife?
Of course they are going to hang whoever would do this to the President of the United States. Sarah was governor I believe at the time so he should get something. Mrs. Obama? I doubt it. If Sarah had been a civilian at the time it would be looked at differently, but since she was governor at the time, it will be looked at seriously in front of the jurors. I believe he will be found guilty but probably get 90 days in jail. He is not going to jail and throwing away the key...no way.
