Oklahoma passed strict immigration laws in 2008 but haven't been challenged.

There’s a strong case against it being found unconstitutional.
The feds powers re immigration are to “make uniform” the standards and rules for immigration.
But NOT to enforce them! That was still up to the states!
If the fed abdicates its responsibilities, and it clearly appears to have done so, the states have every right to take action.

Which just means that Judge Napolitano just outed himself on the issue of Illegal Immigration more than anything else.
