The Civil War (north) or War Between the States (south) was not fought to end slavery it was fought because the Feds wanted to dictate to the states what to do. The states that seceded did so because of States Rights. It was not until 1863 with the Emancipation Proclamation that slaves were to be freed by the states that seceded and when they rejoined the union they had to allow the slaves to be freed
The tenth amendement allow the states to pass legislation that the people of the state desire. For example in the State of Michigan - medical marijuana was legalized by the voters in November 2008 - but wait the municipalities have decided to review the states jurisdiction, because many of the municipalities are saying no to medical marijuana.
