SAN DIEGO -- Sex offender John Albert Gardner pleaded guilty Friday to murdering two teenage girls in San Diego County after prosecutors agreed not to seek the death penalty.
Gardner, 31, faces life in prison without parole for killing 14-year-old Amber Dubois and 17-year-old Chelsea King. He also pleaded guilty to attempting to rape another woman who was jogging in San Diego last year. Gardner, wearing a dark blue jail jumpsuit with his shackled arms hanging at his sides, said nothing but "yes" repeatedly as the judge asked him for his pleas.
District Attorney Bonnie Dumanis said Gardner led authorities to the skeletal remains of Dubois two days after authorities charged him with the murder of King. He did so on the condition that prosecutors not go public with the information or use it against him in court. However, officials could use any evidence obtained from the crime scene to build their case, Dumanis said.
"This was a somber decision," she said. "To end the anguish of the unknown for the Dubois family and to bring Amber home, we agreed." Dubois vanished in February 2009, and the investigation produced few solid leads until King disappeared Feb. 25 during an afternoon run in a San Diego park about 10 miles south of the site where Dubois vanished.
Gardner was arrested three days after King disappeared. He initially pleaded not guilty to her killing.
In a surprising turn, Gardner admitted Friday to kidnapping, raping and stabbing Dubois. He also admitted dragging King to a remote area where he raped, strangled and buried her.

at least the family has some level of resolution. the Death Penalty can be a card the prosecution can play with even the vilest sub-human.

In cases like this, I like to take an old Testament remedy to problems like this. Please refer to Exodus 21:22-25!
In reality he may face the "death penalty" by not facing the death penalty!
If he was sentenced to death by a court, he would be placed on death row and wait while years and years of appeals make their way through the courts. However in the general population or even segregated someone someday will get him with a shiv or some other method. Sex offenders are given special "consideration" by the other inmates and some gang member will want to enhance his gang standing by offing this guy.
The death penalty is a joke in CA anyway.
The monster would die of old age on death row.
Wow. They got him for Amber's murder too! Not that there was really any doubt when her body was found so soon after Gardner's arrest.

My co-worker (Amber’s uncle) knew what was happening last night but was under a gag order not to reveal until 2:30 PST.

I’ve long ago had it with pedophiles. They can’t be cured, but we can sure damn well cure society from them.

He led them to Amber’s body with the condition that it would not be used against him in court.
The DA stated that unfortunately they couldn’t get enough evidence at the crime scene and otherwise to guarantee a conviction against JAG for Amber’s murder, let alone even attempt to get it with special circumstances to go for the d.p., and knew this was the only way to also get him for Amber’s murder.
So they approached Brent and Kelly King yesterday and let them know where things were at, and so for that reason (and others they gave) they agreed to support the getting him to agree to life in prision without parole and without appeal.
They also stated that unless JAG agreed to this deal, it likely ::never:: would have come out that JAG led them to Amber’s body, because even after trial, there’d have been sentencing and inevitable appeals.
