Adolph Hitler's contempt for traditional German law had been manifest from his earliest days as leader of the National Socialist German Workers' Party (NSDAP). The NSDAP's Twenty-Five point programme of 1920 proposed that existing law 'be replaced by a German common law'. By implication the NSDAP believed that the primary purpose of law should be to serve a racially defined Aryan national community enshrined in a 'strong central state power' that would replace the democratic Constitution of 1919. Hitler shared the Party's rejection of the principle of equality for all before the law. However, by 1921 he had confused the exclusivist principles of the Party by imposing one of his own, namely that the 'Leader Principle' (Führerprinzip) should be the law of the Party. It was the 'will' of the Party's Führer, and therefore the 'law' of the NSDAP, that the single-minded, ruthless acquisition of political power should take priority over other considerations.

BO’s boss knows their days in power are numbered—stacking the court means we can be oppressed & abused for decades to come.

Notice he couldn’t wait till Nov when repubs have some control.

Let’s see if any of them grow a spine this summer pre election.

Actually, he makes Hillary first choice, gets his surrogates to pressure her to resign to prepare for the hearings, then watches her go down in flames.

Only problem is there MIGHT be someone in the WH smart enough to know that having the Clintons' dirty linen aired in public right before the election is not a good idea

I wanted him to last at least until we had a better chance to get a better candidate with more GOP Senators in 2011. Maybe the GOP will have the balls to filibuster until then.

Doing a nine month filibuster is impossible, not ballsy.

The nominee will be confirmed before the fall session of the court. The task for the GOP is to make the public aware how ideologically alien the person is.

I wonder if someone was promised a seat on the court in exchange for their health care vote - perhaps Harry Reid?

Also, does any know if the replacement vote can be delayed until after the November midterm?

I agree. Plus, it will force the rats to spend a lot of time fighting about this. Meanwhile, they won’t be able to commit other sins. Hopefully, it will keep the senate all tied up for two or three months.

My thought as well. He’ll nominate a muslim in his 30s.

As for McCain, this was the best reason to vote for republicans in this election, because I knew the court was just trying to wait him out. I fully expect Ginsburg to retire before November too.

Oh, btw, this represents the second republican nominee to retire under a democrat.

"Acting president" pending certification of the election of a person who is eligible to be President by Congress.

I haven't done extensive work on this question myself. But some loose talk seems to assume that although the succession issue is clear when you have the election and the President dies before assuming office, it neglects to provide that the VP succeeds when he has been certified but Congress has not yet acted to certify an eligible person as President.

The Amendment then continues to provide that the VP is Acting President pending certification of the eligible person. If you have no eligible persons who got electoral votes (and thus no two persons from whom to choose), lawyers further seem to think that implies the power in Congress to adopt a procedure for electing the ultimate president.

Or, Joe could presumably (again not a subject I have researched and maybe the answer is otherwise) appoint a justice himself as Acting President.

They won't do that because to do so would amount to a concession that Barack is not President. So at least as to Sonya, she affords the perfect target on which to resolve the eligibility-born in Kenya issue. If Barack acts to appoint a successor for Stevens, that person would be a second target. An opportunity to get the court down to seven members of which four are conservatives.

Is it justiciable? Haven’t most of these cases been kicked for saying congress and the states are the ones to ensure eligibility?
