Iowa Legislature Passes “Shall Issue” Right-to-Carry Legislation!

On Monday, March 29, the House of Representatives passed Senate File 2379 by a vote of 81 to 15 and it will now head to Governor Chet Culver (D) for his consideration. SF2379 had previously passed in the Senate by a vote of 44 to 4. This bill is a huge victory for gun owners in the Hawkeye State and reinforces the legislature’s intent to treat the provisions of the Second Amendment as rights, not state-granted privileges.

This NRA-backed bill would change Iowa from a “May-Issue” state to a “Shall-Issue” state.

The Governor of Iowa would be best off not vetoing this thing, as there is more than a 3-1 margin of passage (well more to beat a veto).

I’m in CA (SF Bay Area) and I wish things were more like Iowa here.

Earlier this evening I stopped by a local convenience store to pick up a snack. The store clerk was boarding up the windows of the adjacent shop, a coffee house. The window covers were of heavy plywood on hinges, fastened by a couple of thick wooden bars.

“That’s a good old-fashioned way to close a window,” I said.

He shrugged. “We have to do it, they break the windows and get in here before the alarm goes off. So we have to board up the windows.” He gestured to the iron bars over the store windows. “We don’t want to have these, it doesn’t make us look good, but what can you do.” He added that some other people had broken in recently by dropping in through the back roof. “What are they looking for? There’s no money here.”

“They’re desperate for even the smallest amount of money. It’s for drugs,” I said. “Look at the little tiny zip-lock bags you see lying [as litter on the ground] around here. What else could those contain.”

I went on to mention the gunfire I’d heard the night before (three sharp reports) at around 1:00 a.m., then on my morning walk to the bus stop, saw a spatter of blood at an intersection near a freeway offramp. The blood looked fresh. “That must have been from last night,” I said. “The blood covered an area this large,” I spread my palm out over the counter to show him. “And I never heard any police sirens.”

He mentioned the gunfire that was so common in the neighborhood that the cops wouldn’t even come running over a shot or two.

At that moment an older fellow walked in to buy something in a can which he covered with a brown paper bag.

He joined our conversation in progress and it turned to guns and gun control.

The older fellow said he was a security guard and had to wear a gun for his job, but didn’t wear it at home. He said he was adamantly against people owning guns. “They should be illegal,” he said, his voice rising.

The shopkeeper and I disagreed. “I see nothing wrong with a law-abiding citizen carrying openly,” I said. “I’d feel safer knowing they were legally carrying.”

The older man was adamant. He brought up the example of the Black Panthers bringing guns to the State Capitol in the 1960s.

“Yeah, but they make you go through security at the Capitol” I said.

“Not then they didn’t,” he retorted.

The older man went on, “How would you feel [waving at the shopkeeper and myself] if someone came into a store with a gun?”

“I’d feel fine if he was legally carrying and he just had it holstered at his side,” I said. “If he was a criminal pointing it at me, no, I wouldn’t like it.”

The older man would have none of this. “Suppose someone just LOOKED at you the wrong way and the gun just went off, what then?”

At this point we were conversing, the two of us, him in the street outside, and myself in the open doorway. I decided to agree to disagree with him and just say good night.

After he left, I turned to the shopkeeper. “I think we were talking about two different things.” He nodded.

The shopkeeper is from a South Asian country. He’s an immigrant and runs the shop with his family.

The older man was an American.

The Legislature isn't scheduled to be in session again until January 2011. So, if Culver vetoes the bill, it'll be one of his last memorable acts as Governor (he's already going to lose in November).

I’d really like to shop in Iowa without having to disarm before doing so. To find the same stores on this side of the border I would have to drive much further. I hope he signs it.

This is all to give Dems something to crow about and distract the voters, and the legislation isn’t as strong as I’d like it. But, I’ll take it.

Scott country has been fairly easy to get permits for a couple years now.

I respectfully disagree.

I acquired my first handgun “purchase permit” about a year and a half ago. At that time, one of the local gunsmiths told me that Sheriff Conard was reasonable in issuing carry permits. It was only about two days after that that the sheriff was quoted on the front page of the Quad City Times that his office does not consider “self defense” a valid reson for being issued a carry permit.

You needn't just take my word on it, please read what is posted on the Scott County Sheriff's web site:

Permit to Carry Weapons (Non-Professional)

A Nonprofessional permit to carry authorizes the permit holder to carry weapons within the restrictions set by the issuing officer. ( Scott County does not issue permits for self-protection)

If you wish to apply for a permit to carry a concealed weapon under the justification of Demonstrated Responsibility, you must do the following things:

Write a letter to the Sheriff that addresses the following information:

* Knowledge of the Iowa Code Sections dealing with the use of force and specifically Chapter 724 Weapons. (you can find this by using Internet search Iowa Code Chapter 724, or at the library or http://www.legis.state.ia.us)

* Knowledge of the liability you may face for the improper use of a firearm.

* Your familiarity with firearms and their use.

* Security, corrections, law enforcement or military experience.

* Memberships in gun clubs, collectors’ organizations or other organizations.

* Other factors that demonstrate your responsibility with weapons

* Justification the Scott County Sheriff will approve, (ie, business owner, landlord)

About the same time I received my carry permit under “Demonstrated Responsibility”. Self defense was not considered a valid reason, but that was.

One NRA basic pistol class and a letter later I received my permit. Talking with the ladies in the court house, I suspect that wording was used to keep the Davenport city council from flipping out.

IowaCarry.org has the procedure you need to do to get a permit.

It is a bit silly you have to say “Demonstrated Responsibility”, but that is what they want. The sheriff's website must not have been updated.

Thanks for the info on IowaCarry.org.

I’ll definitely check into it. (Both the wife and I could use a good pistol course anyway. My expertise has always been long guns.)

We must be neighbors. Do you live in Davenport?

Although the Linn County Sheriff will issue permits for "self defense," the previous one would not.

But, if you said you routinely carry $500 cash on your person, he would accept that as justification. Rumor was, if you were ever stopped by a L.C. Deputy, you had better be carrying $500 cash if you were packing.
