Dems' 'deem' scheme

Nancy Pelosi is a coward, a bully and a hypocrite -- and Barack Obama is hiding behind her skirts.

So what does that make him?

Pelosi obviously can't find enough votes in her own party for ObamaCare, so the House speaker is preparing to approve the president's health-care bill by legislative legerdemain -- that is, by not voting on it.

And to hell with the Constitution.

Not to mention President Obama's long-abandoned vow that the health-care-reform process would be "completely open and transparent."

Indeed, Pelosi has just the opposite in mind: She intends to employ an arcane bit of backroom alchemy known as "deem and pass," in which the House would vote on a few less-controversial fixes to the Senate's health-care bill.

Justice John Paul Stevens, writing for the court, defined the procedure in the line-item case as having three steps: approval of a bill by one house, approval of the “exact text” by the other house, and a presidential signature. “The constitution explicitly requires that each of those three steps be taken before a bill may ‘become a law,’” he wrote.

No it is not Constitutional, even from a liberal Justice.

That should be grounds for impeachment right there!!! Hell, it should be grounds for pitchforks, tar, feathers and a rail!!!

They can “deem” until the cows come home, but the American people will have no trouble telling who to hold to account for this. Just look for the ‘(D)’ after the name.

Some congresscreatures, maybe even most, are stupid. No one ever elected has ever been this stupid. Even the dumbest box of rocks in DC knows if you deem something passed, you want it passed.

On Fox last night, this was a big subject, of course. Everyone who spoke on the matter thought the deem-pass scheme laughably transparent except for Bill O’Reilly who seemed to think that the American public is too dumb to see that a vote for the “Slaughter rule” is actually a vote for Obamacare.

Millions of Americans are following this situation intensely. The “self-executing” trick will fool only the very few who are as dense and clueless as O’Reilly.

He is absolutely the worst, most stunningly inept and incompetent politician to ever win the presidency. Nothing he has ever said is more true than “I don’t know about the politics.”

Not even “My time doesn’t count ‘cuz I’m the prez.”

They should be talking about the fact any federal version of health care on its face is unconstitutional since Article 1 Section 8 of the Constitution does not specifically grant Congress the power to regulate health care. The “deem” scheme violated Article 1 Section 7 as it requires both chambers of Congress to vote on bills. The people are not bound to comply with any unconstitutional act of Congress! This is the point people need to hammer home with their politicians!

Not only do you want it passed, you own it. And here's the Republican strategery: in this video and in a letter they sent signed by all 41 Senate Repubs, they tell the House Rats upfront, in no-uncertain terms that they WILL block changes to the Senate bill. This is a clear shot across the bow. They are saying, “Don’t buy that garbage about how you can deem this passed because the Senate bill is going to be ‘fixed,’ because that’s NOT going to happen. You deem the Senate bill passed, you own it.”

The Senate Repubs also explain their strategy on the pro-life issue, that they will immediately file a lawsuit if reconciliation is attempted without passing the Senate bill, etc.

Help the Senate Repubs get their message out!

I've heard liberal callers say Republican-controlled Congress used deeming routinely.

I'll be deemed. Yes, but not routinely and if this example is typical, only for dire emergencies.

Efforts to force a balanced budget in 1996 shut down government.

As the dispute between the Congress and the White House continued the House and Senate did pass a spending bill to restore temporary pay for government workers and temporary funding for some programs but not all programs. A second bill was passed by the House to temporarily restore a few other programs meant to be in the first bill.

You may recall it was all quite a donnybrook and, given the Clinton-adoring MSM, wreaked havoc upon the GOP-controlled Congress. It was 24/7 tales of woe for the victims of Republicans.

The immediate need for a second temporary funding bill was recognized and the Senate agreed by unanimous consent that once it arrived from the House, it would be "deemed passed." It did not matter to the Majority Leader Senator Dole that the House had not even passed the second temporary fundingbill.

This was an urgent and temporary matter -- contrary to how dissimulating lefties argue that deeming was done routinely by Republican-controlled Congress for all manner of legislation hated by the majority of Americans.
