Yakima kindergartner expelled for making a gun with hands

YAKIMA, Wash.- Manuel Alvarez eats breakfast and gets ready for school. He's eager but nervous. He was expelled Monday from Barge Lincoln Elementary for making a gun with his hands. His mom says it's a hand gesture that could have easily been corrected.

"He didn't know did they talk to him about it what actions were taken to tell him this isn't allowed," Lorena Hurtado, Manuel's mother.

Manuel has a clean record never in trouble before his mother says a warning would have worked or even a parent-teacher meeting. Instead, His mom says, Manuel's afraid.

"I got a call from the School saying he's not raising his hand or speaking up. He's scared after we talked about not doing any gestures, he probably doesn't want to to do it because that could be a gesture. It might get him pulled out for two days," said Hurtado.

Manuel's mom doesn't see anything wrong with her son putting his hands like this and shooting down at the ground. She doesn't think it poses an immediate threat to the school or Manuel's classmates. We took the issue to School District employees and asked them about their policy.

"When students are at school they should be concerned about learning….safety shouldn't be a concern at school, we have a zero tolerance policy," said Dr. John Irion, from the Yakima School District.

Hurtado understands the policy, but in this case doesn't think the punishment fits the crime, especially when the student in question is in kindergarten.

"A five-year-old shouldn't be held to the same policy as a 12th grader...he is in kindergarten," said Hurtado.

Lorena Hurtado is appealing the expulsion and wants to try to clear her son's record. She says she doesn't want her five-year-old to be labeled as a troublemaker.

I’m not Catholic either. But if I had children, they would never set foot in a government school.

Lol. This is just too ridiculous. I would tell the school district not to worry about suspending because he will not be back. Any person that is too stupid to discern between a K-er playing guns and an older student making a threat is too incompetent to teach my child anything.

Agree with you. The child is in K, has never been in trouble, pointed his “gun” at the ground, and is scared “too death” over a suspension. It is beyond silly.

I would go so far as to say that this Institutionalized Learned Helplessness extends even into the armed forces. As an example: the UCMJ states that it is an offense for an OFFICER to criticize a senator/representative/Governor in that politician’s AO; various ‘memos’/directives apply that article of the UCMJ to NCOs and enlisted as well.

Furthermore there is the saying: “Just because you defend the Constitution doesn’t mean it applies to you.”

This is an example of a national agenda in the public schools that's been ongoing for at least 40 years

This sentence implies that our socialist-model, single-payer, government schools were not broken 40 years ago, or that if we could return to some nebulous time in the past that the government schools could be fixed.

Please think carefully about this.

Government schools **are** the very definition of socialism. They have always been the very definition of socialism. Socialism can not be fixed.

That we have government schools at all is because the Utopian progressives of the 1800s lobbied for them. The Utopian progressives have **always** controlled teacher training and curriculum development. It continued in the late 1800s and early 1900s with Mann and Dewey. The gradual push has always been toward more and more atheistic secularism, a more and more permissive and liberal worldview, and, now, outright Marxism.

Simply by attending socialist-model, single-payer,government schools, children have learned ( from the mid-1800s onward) that government has the power to take money from their neighbor to pay for a socialist service that their parents want for tuition-free. And...Their teachers teach them that it is a **right**! Well...If the government can give tuition-free schooling, why not a thousand other wants and needs?

Within one to three generations ( my parents, grandparents, and great-grandparents) we had:

**the IRS
** the direct election of Senators
** the federal reserve
** Unions
** feminist movement
** One World fantasies in the form of the failed League of Nations, followed by the abominable U.N.
** FDR and his New Deal for four terms
** Lyndon Johnson's Great Society
** the abolishment of the gold standard
** and thousands of socialist programs and agencies

Government schools teach children to look to government as GOD. They have always pushed in the direction of secular atheism. They **are** socialism and they can not be fixed.

Government schools must be abolished if we are to save this nation. I **seriously** mean it.

Why would anyone compare a 5yo boy making his fingers look like a gun with a child soldier taught to kill people?

If the two are the same, then please help me - I’m living in a house filled with child soldiers. They pretend to shoot at each other everyday.

Buyer BEWARE!!!

My daughter taught math in a Catholic K-12 school in the Houston area. Every one of the teachers and principal voted for Obama. They are utterly mired in Marxist social justice.

I am also a graduate of Villanova University. In the 1970s they were thoroughly marinated in Marxist social justice. I expect it is worse now.
