Cuccinelli seeks to block EPA’s global-warming petition Attorney general disputes climate change...

Attorney general disputes climate change data

Virginia Attorney General Ken Cuccinelli said in a press conference Wednesday that the climate change data used by the EPA is flawed.

A federal decision that global warming poses a threat to people relied on faulty data and will hurt jobs, Virginia Attorney General Ken Cuccinelli says.

The December decision by the Environmental Protection Agency opens the door for the agency to crack down on cars, power plants and other sources of heat-trapping gases.

"An incredibly far-reaching decision has been made using a clearly flawed process," Cuccinelli said at a news conference yesterday.

The EPA, he said, apparently relied on information that was "unreliable, unverifiable and doctored."

Cuccinelli filed petitions with the EPA and a federal court Tuesday seeking to block the decision.

He said the EPA should consider new information, including recently publicized e-mails from a British climate-research office. The e-mails showed scientists using faulty data to support the notion of manmade global warming, Cuccinelli said.

According to Cuccinelli, that faulty data made their way into a key 2007 climate-change report by a United Nations panel and ultimately were used by the EPA to make its finding that global warming threatens the public.

Many global-warming skeptics have been calling the British e-mail flap "Climategate" and saying the messages disprove the notion that people are warming the planet.

Bruce A. Wielicki, senior scientist for earth sciences at the NASA Langley Research Center in Hampton, said the British e-mails do not undermine the voluminous research that shows people's actions are warming the Earth...

Texas has filed similar challenges to the EPA decision.

The AGW Smoking Gun

A key component of the scientific argument for anthropogenic global warming (AGW) has been disproven. The results are hiding in plain sight in peer-reviewed journals.

--snip--

The science behind the AGW hypothesis is that increased amounts of CO2 in the atmosphere (that humans produce by burning fossil fuels) will block more outgoing long-wave IR radiation (OLR) from exiting the atmosphere and thereby warm the surface.

--snip--

So the results of three different peer-reviewed papers show that over a period of 36 years, there is no reduction of OLR emissions in wavelengths that CO2 absorb. Therefore, the AGW hypothesis is disproven.

It should be noted that another paper written by Richard Lindzen and Yong-Sang Choi (both work at MIT's Department of Earth, Atmospheric and Planetary Sciences -- Lindzen is a professor and Choi is a postdoctoral fellow) reveals the differences between the measured OLR and its impact on temperatures vs. climate models. In the paper, the data showed that OLR increased when sea surface temperatures increased, so this is in direct contradiction to the AGW hypothesis that less OLR should be emitted since more CO2 is absorbing it and warming the planet. Furthermore, in contradiction to the climate models, these results show that OLR is acting like a negative feedback (cooling the surface) instead of a positive feedback (radiative forcing). The Lindzen and Choi paper dealt in general with all OLR wavelengths and didn't show granularity with respect to specific wavelengths that were related to various GHG absorption, but the fact that the entire OLR emission spectrum didn't behave like the eleven climate models' predictions means that "the science isn't settled."

IMHO, the title should have been, "The Four Anti-AGW Smoking Guns."

IMHO, I can see about three dozen state attorneys general opposing the EPA all the way to SCOTUS.

Thanks Army Air Corps and neverdem.

Virginia has joined Texas and several other States with blowback to the federales on the mickey mouse EPA regs and algore warming scam. Let's light this candle.

I think that state governments and other industries like Peabody Coal should sue this out of the EPA. A tidal wave of lawsuits would overwhelm the EPA weakening it......on a side note, this is something that even Alinsky would admire.

Furthermoe, I have been waiting for class action law suits filed by investors and other effected parties against AlGore and other scammers especially those in “higher learning”.

I do indeed like my new Governor and his team here in VA! Combine this move with the repeal of the “one-handgun-a-month” law and cuts to the state budget — the Old Dominion is turning a nice shade of red.

Noobie here. Keep in mind that the States created the Federal government. The “creator” is always greater than the “created.” The States should never go hat in hand to a Federal court where their State sovereignty is involved. Therefore, Cuccinelli should have simply informed Washington that since the science is flawed and has a very negative impact on Virginians then Virginia will block any new EPA regulation. End of story.

Hurrah for the Bonnie Blue Flag ...

Last time Virginia told the Feds to pound sand, it didn't turn out too well.

Thanks ForGod'sSake. Uh-oh, looks like the debate is over. ;')

About the only type of tort "reform" we're likely to see is a prohibition against lawsuits against the global warming leftist demagogues.

Thanks Civ. There are probably two dozen or more threads running on the blowback to the EPA nonsense creating a challenge to keep up without a program. Several threads each for the various states, not to mention at least one thread re Peabody Coal’s(?) lawsuit against the EPA. More feral government generated welfare for ambulance chasers. Their wet dreams come true. Maybe they’ll leave the doctors and hospitals alone for a while.
