IMMEDIATE RELEASE No. 060-010 January 22, 2010 Military Commission Charges Withdrawn In Sept. 11 Case
The Defense Department announced today that the convening authority for Military Commissions withdrew and dismissed the charges, without prejudice, against the five detainees charged in the Sept. 11, 2001, attacks.
This action comes in light of the announcement by the attorney general of the United States that the Department of Justice intends to pursue a prosecution of Khalid Sheik Mohammed, Walid Bin Attash, Ramzi Bin al Shibh, Ali Abdul Aziz Ali and Mustafa Ahmed Adam al Hawsawi, in federal court in the Southern District of New York.
Given the determination that prosecution of these detainees will be pursued in federal court, it was appropriate to withdraw the pending military commission charges and dismiss them without prejudice. This action is a procedural step, which is part of a normal process, when an alternative forum is chosen.
The convening authority took a similar action May 29, 2009, when charges against Ahmed Khalfan Ghailani were withdrawn and dismissed without prejudice after a decision was made to pursue prosecution of Ghailani in federal court.

All charges have been withdrawn in the military commissions against the five suspects in the Sept. 11, 2001, terror attacks being held at Guantanamo Bay.
The charges were dropped “without prejudice,” according to the Defense Department — a procedural move that allows federal officials to transfer the men to trial in a civilian court and also leaves the door open, if necessary, to bring charges again in military commissions.

This is what's laughable about this whole idea of trying them in Federal Court. People - to include the administration - are pretending that they have some control over where they'll be tried. They don't. It's a matter that, for all practical legal purposes, is left entirely to the Court. And, Federal Law gives great deference to the right's of the accused with respect to where the trial will be held. Essentially, the government could file the indictment in Alaska, then the defendant could (and would) move to change venue. In all likelihood, that motion would succeed.
This is but ONE of the thousands of things that can (and probably will) go against the government in Federal court.

Not that it matters to this discussion, but since you are/were a "submariner's wife", I am one of four consecutive generations that served in the Corps, with a couple of sons that served in the Navy. So, I am a big supporter of the military.
You should be well aware of how the chain of command works.
They aren’t “sucking up”. Obama calls the shots as CiC. The military or their recommendations don’t matter to him. I would be surprised if Gates has a measure of influence with this asshole.
PS I am still an active duty Navy wife.
