Handcuffed, disarmed for obeying the law

Charlie Mitchener is a 61-year-old general building contractor with an office near Patrick Lane and Fort Apache Road in Las Vegas. He holds permits allowing him to legally carry concealed weapons in Nevada, Florida and Utah.

Over the past three years, his office has been broken into five times. "Three of those occasions involved me interacting with Metro," he wrote to me recently. "Each of the occasions began the same: my introduction, my presentation of my Nevada drivers license and my concealed firearms permit. Prior to today, each Metro officer simply replied thank you, proceeded with his work and then when complete there was a conversation about firearms."

Things were real different at 5:30 a.m, Jan. 3, however, when Mr. Mitchener called Metro to report the fifth break-in at his office.

"Vin, I hope I did not see the future this morning," Charlie e-mailed me. "Today was drastically different."

The responding officer was a lady cop, officer J. Rogers, badge number 13525.

"Upon presentation of my (firearms permit), the officer asked if I had the weapon on me to which I replied yes. She then said to spread my legs and put my hands behind my back. I complied and she then handcuffed me. While doing so, she said that she wanted to make certain 'that we were all safe.' "

Officer Rogers stripped Mr. Mitchener of the Glock 19 he was carrying, took the weapon and locked it in her patrol car.

Mitchener should consider himself lucky. Once the cuffs were on I’m surprised this jack-booted thug copette didn’t Taze him.

Seems like tazing is part of their way of dealing with many situations any more.

I used to be very supportive of the police but I have lost faith in the system. They’re just one more unknown that has to to be dealt with.

Well, ma'am, you dropped into the middle of the knee-jerk brigade. The usual situation is an article by an author who is well-known for a particular point of view. The author tells a terrible-sounding story that is so outrageous that, were it true, it would be a bad thing.

The problem is that such articles only tell one side of the story -- that of the supposed victim, who of course tells the story in a manner most sympathetic to himself.

There is almost always more to the story, however. For example, we might wonder if Charlie Mitchener was as meek and mild as he's painted here; I have a feeling that he was more than a bit agitated. If so, it casts the whole story in a different light.

So back to your question: it's not really because the cop is a girl, it's because these guys will latch on to anything that gives them something to shout about.

Just because they can doesn’t mean that they should. Men and women are inherently different, both physically and mentally so it just makes bad policy to put them in situations that they are not equipped to handle and which leads to this type of abuse. Same goes for being Prez, I really don’t want some woman on PMS with her finger on the nuclear button.

The cops don't get it. The Constitution does not say "the right to keep and bear arms shall not be infringed unless such infringement makes an officer of the government feel safer." The biggest reason the American populace are armed was never to fight off bears or wild Indians but to make agents of the government feel unsafe -- really, really unsafe -- should they try to take away our rights. That's why a citizen militia is "necessary to the security of a free state."

If these arrogant, uniformed employees of ours really want to treat us as the enemy, they may eventually get their wish, at which point they will discover they're vastly outnumbered -- and "backup" is never quite close enough to solve the problem they've created for themselves.

Oh, so if you're a bit agitated because your business has been burglarized again after many times, you lose your right to carry a firearm? Brilliant!

BTW, did you read the part where the cops didn't dispute Mitchener's story?

Does not the police department involved have a standard procedure for handling encounters with citizens who have a lawful permit? If not that's a serious oversight on someone’s part and needs to be addressed immediately.

The treatment a citizen receives when presenting a legal permit like this is too important to be left to the discretion of an individual officer.

Just my two cents worth.

If a cop can handcuff someone on the subjective feeling of unsafe, when will they be able to toss someone in jail without charges on similar feelings?

p.s. and there are always two sides to every story. If the citizen was upset and yelling/cursing the cops for incompetence then she probably did the right thing.

With the police saying they do not dispute Mr. Mitchener’s story it is a stretch to absolve the officers action. There is a point on the officers lack of physical , I work as a firefighter , we have women in our battalion guess who carries the heaviest ladders, the most hose etc and on and on....

There is no problem with "lady cops." If you are a male confronted by a "lady cop" situation, then you better make some quick adjustments to attitude and personal safety.

By virtue of being a "lady cop," the officer is immediately at the overwhelming physical disadvantage even a 5'2", 65 yr. old, scrawny male presents in the confrontation. The "lady cop" instinctively, ineffably knows this to her core. To overcome her rampant, heart pounding fear of being physically overcome if the dastardly brute gets within 5 feet of her, she must take decisive action. Nothing is more dangerous to an American male than this LONE LEO. Without backup, she can and will take any male action that is not spread-eagled on the floor as an imminent threat. She will not reason, negotiate, reach for a stun gun, pepper spray or baton; her mission is to draw her firearm and kill the threat. In her eyes she has no alternative; she will not win in any other physical confrontation.

My advice? When confronted with the lone "lady cop," get down on your knees and put your hands behind your head. Speak with utmost deference. Do not offer ANY information which will torch off the Lady LEO into rabbit panic, resulting in a multiple bullets in your cranium.

I just emailed both sites listed as contacts on the Las Vegas Police dept site, asking why this cop acted as she did, asking if she will be punished, educated as to the rights of American citizens, or terminated if she should trample on constitutional rights in the future. I suggest everyone else reading this story do the same. This is exactly what happened—though of course was NOT REPORTED—in New Orleans after Katrina. Thug cops confiscated the firearms of law abiding citizens. It is inexcusable and extremely DANGEROUS to the rights of American citizens everywhere. The officer should be terminated. A stand should be taken with this event and demands for her removal from the force should be shouted from every part of the nation. The NRA should lead the cause.
